<br />NOW, THEREFORE, BE IT RESOLVED <br /> by the City Council of the City of <br />Charlottesville, Virginia that the sum of $761,200 is hereby appropriated in the following <br />manner: <br /> <br />Expenditures - $761,200 <br />Fund - 105 Cost Center - 1911001000 G/L Code - 540110 <br /> <br />APPROPRIATION <br />c. : $105,705 – Fire Department Grant (carried over) <br /> <br />APPROPRIATION <br />d. : $2,379.43 – Donations to Police Department (carried over) <br /> <br />RESOLUTION <br />e. : Special Permit at 600 Preston Avenue to Allow Expansion <br /> of Grocery Store <br /> <br />WHEREAS <br />, Brooks Family, LLC (“Applicant”) has requested a special use <br />permit with respect to property identified on City Tax Map 32 as Parcel 13 (600 Preston <br />Avenue), consisting of approximately 34,310 square feet, or 0.788 acres (“Subject <br />Property”), to allow construction of additional storage space at the rear of the existing <br />grocery store building; and <br /> <br />WHEREAS <br /> , the subject parcel is zoned “CC” (Central City Corridor), where, <br />pursuant to Section 34-796 of the City Code, such modifications for use of the property <br />are allowed by Special Use Permit; and <br /> <br />WHEREAS <br /> , a joint public hearing on this application was held before the City <br />Council and Planning Commission on December 11, 2007, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br />WHEREAS <br /> , on December 11, 2007, based on the information presented by <br />Neighborhood Development Services staff as well as by the Applicant, the Planning <br />Commission recommended that the application be approved with conditions; and <br /> <br />WHEREAS <br /> , this City Council finds and determines that granting the Special Use <br />Permit would be consistent with City Code Section 34-796, and the criteria generally <br />applicable to special use permits under Chapter 34 of the City Code; now, therefore, <br /> <br />BE IT RESOLVED <br /> by the Charlottesville City Council that a special use permit <br />is hereby granted for construction of a 3,333 square foot addition to the rear of the <br />existing building on the Subject Property, subject to the following conditions: <br /> <br /> <br />a.The storage addition’s design must allow for unimpeded vehicular circulation <br />throughout all drive aisles of the Subject Property. Drive aisles must remain <br />within the property lines, and must be improved with asphalt. <br />b. The site plan amendment will be reviewed by the Planning Commission, and <br /> the applicant will consider the Planning Commission’s recommendations <br /> <br />RESOLUTION <br />f. : $14,492 – Carryover Funds for Drug Court <br /> <br />WHEREAS, <br />the Charlottesville-Albemarle Drug Court’s fund balance at the end <br />of FY 2007 is $25,514, of which $14,492 is the City’s share; and <br /> <br /> WHEREAS, <br />the Charlottesville/Albemarle Drug Court has requested that these <br />funds be used to contract for an outcome evaluation of their program. <br /> <br />NOW, THEREFORE BE IT RESOLVED <br /> by the Council of the City of <br />Charlottesville, Virginia, that the Charlottesville/Albemarle Drug Court is authorized to <br />carry over the sum of $14,492 from Fiscal Year 2007 for the above-stated purpose. <br /> <br />ORDINANCE <br />g. : “AN ORDINANCE AUTHORIZING THE GRANT OF <br />TH <br /> UTLITY EASEMENTS UNDER 11 STREET, S.W.
