196

Ms. Slaughter said that she would want any part of the mall included in a BID to
remain public and under the review of the Board of_Architectural Review, and noted that she
wood ultimately like to see all of the mall included in such a district rather than only one
segment.

It was noted that lands from a BID could be used for marketing, security, maintenance,
parking and public improvements.

Ms. Richards said she thinks funds from a BID should supplement, but not supplant the
City's Police Department security, and that the City's security should have authority over
other security measures.

Mr. Cox said he feels a BID should accommodate the fullest range of business owners
and widest variety of views on the mall, and if that is done, then a "test" area would be
agreeable.

Mr. Jim Gahres, Director of Economic Development, said that he feels a pilot BID area
would make sense and would be attractive for the major business owners downtown who are
interesting in making downtown successful. Mr. Gahres said the majority of businesses
downtown seem to be interested and he thinks common ground could be found to include all
views. Mr. Gahres said that if the City paid for a consultant to do the study for the entire
mall, others would be brought into the process.

Mr. Toscano said he is reluctant to move forward on funding a consultant until he sees
interest by others.

Ms. Daugherty said she feels the process needs to be led by the private sector.

Ms. Richards recommended that a contingency be built into a BID that it has to grow in
order to continue.

Mr. O'Connell suggested that the interested business owners be given Council's
conditions and have them bring back a proposal.

Ms. Richards recommended that what "remains a public space" be clarified.

The meeting was adjourned.

NOTICE OF SPECIAL MEETING

A SPECIAL MEETING OF THE COUNCIL WILL BE HELD ON Tuesday, November 12,
1996 AT 9:00 a.m. IN THE Second Floor Conference Room.

THE PROPOSED AGENDA IS AS FOLLOWS:

Executive session as provided by Section 2.1-344(A) of the Virginia Code

BY ORDER OF THE MAYOR BY Jeanne Cox (si~ned_)

SECOND FLOOR CONFERENCE ROOM - November 12, 1996

Council met in special session on this date with the following members present: Mr.
Cox, Ms. Daugherty, Ms. Richards, Ms. Slaughter, Mr. Toscano.

On motion by Mr. Toscano, seconded by Ms. Richards, Council voted, with Mr. Cox
absent for the vote, to meet in executive session for the purpose of consultation with legal
