242 <br /> <br /> COUNCIL CHAMBER - OCtober 2, 1995 <br /> <br /> Council met in regular session on this date with the following members present: <br />Daugherty, Rev. Edwards, Ms. Slaughter, Mr~ Toscano, Mr. Vandever. <br /> <br />PUBLIC <br /> <br />Ms. <br /> <br /> Mr. Francis Fife of Concord Drive expressed concern about the effect on the poor of <br />Congress cutting taxes in order to give tax breaks to the wealthy, and said that he feels the <br />financial burden will increasingly fall to localities. <br /> <br /> Col. Carroll Smith informed Council that the welcoming ceremony for the visitors from <br />Normandy will be moved to the Downtown Recreation Center due to inclement weather. <br /> <br />CONSENT AGENDA <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Daugherty, the following consent <br />agenda items were unanimously approved, with Mr. Toscano abstaining from voting on the <br />cafe permit for the Mud House Restaurant due to a potential conflict of interest: <br /> <br />a. APPROPRIATION: $22,170 - "Respect Equals Success" Program Grant <br /> (2nd reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the sum <br />of $22,170.:00, to be received as a grant from the Virginia Department of Criminal Justice <br />Services, is hereby appropriated to expenditure account 11-020-062084 to implement the <br />project known as "Respect Equals Success", an intervention program for early middle school <br />children with a history of assaultive behaviors. <br /> <br />b. APPROPPdATION: $8,525 - D~ Grant (carried over) <br /> <br />c. RESOLUTION: Approving sidewalk cafe for The Mud House Restaurant <br /> <br /> ~REAS, Ms. Lynelle Lawrence, d/b/a The Mudhouse Restaurant, has applied to <br />City Council for a permit to operate an outdoor cafe on the pedestrian mall at 213 West Main <br />Street connection with the operation of her duty licensed restaurant (Mudhouse Restaurant); <br />and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor cafe is in keeping with the <br />intent of the pedestrian mall, can add significantly to successful commerce in the downtown <br />area, wilt not unreasonably restrict the movement of pedestrian traffic and will not endanger <br />the public health, safety to welfare; now, therefore, <br /> <br /> BE IT RESOLVED that Lynelte Lawrence is hereby granted a permit to operate an <br />outdoor cafe ~on the pedestrian mall at 213 West Main Street, subject to the following <br />conditions and terms: ~ <br /> <br /> 1. The permit shall be valid from its adoption (or effective date if different from the <br />date of adoption) until November 30, 1998, for operation of the cafe during the months of <br />March through November. Not later than November 30 of each year, the operator shall <br />remove from public property alt furniture and equipment used for such cafe operation. <br /> <br /> 2. The cafe shall be operated only in the designated area shown on the attached sketch. <br />No cafe ~shings or equipment shall be permitted to obstruct any fire lane. The designated <br />area of operation shall be clearly delineated by the use of a combination of trees, fences, <br />planters and barriers. <br /> <br /> 3. The cafe shall be operated in full conformity with all State health and alcoholic <br />beverage control re~lations. No food preparation shall be permitted on the mall. The <br />operator shall remove promptly all food dishes and utensils after each customer has left and <br /> <br /> <br />
