23 <br /> <br />Hendrix. <br /> <br />REQUEST: DESIGNATING "FRIDAYS AFTER FIVE" AS SPECIAL EVENT <br /> <br /> Mr. Hendrix stated that Downtown Charlottesville, Inc. <br />(DCI) had requested that "Fridays After Five" be declared a <br />special event and a resolution and ordinance have been <br />prepared to so designate the event. <br /> <br /> Mr. Tom Fitch, Executive Director of DCI, sUppOrted the <br />proposed resolution which he felt would protect the <br />successful event which drew between 3,000 and 4,000 persons <br />downtown every week during the past summer. Mr. Fitch <br />explained that the designation would require all outside <br />vendors to set up outside the ribboned-off area which will <br />allow more persons within the designated area and will <br />address safety concerns raised during the previous year's <br />event. Mr. Fitch stated that this year's "Fridays After <br />Five" will be held on the west end of the downtown mall and <br />it is DCI's intention to rotate the location each year. <br /> <br /> On motion by Mr. Towe, seconded by Mr BuCk, the <br />resolution designating "Fridays After Five" as a special <br />event was unanimously approved by Council. <br /> <br /> WHEREAS, Downtown Charlottesville, Incorporated ("DCI") <br />has requested that the Council of the City of <br />Charlottesville, Virginia, designate DCI's "Fridays After <br />Five" as "Special Community Events;" and <br /> <br /> WHEREAS, these events are scheduled to begin in May of <br />1989 and run through September of that same year; and <br /> <br /> WHEREAS, this Council is supportive of the efforts of <br />DCI and wants to do everything within reason to foster and <br />nurture the~continued vitality of the City's downtown; now, <br />therefore <br /> <br /> BE IT RESOLVED, that said Council, pursuant to City Code <br />Section 25-45.4 hereby designates "Fridays After Five" for <br />1989 as "Special Community Even~ts," which designation <br />suspends the regular code requirement that thOse vending on <br />the Downtown Mall first obtain a certificate of <br />appropriateness from the Downtown Board of Architectural <br />Review. This resolution is made upon the following <br />conditions: <br /> <br /> 1. No vendors, whether DCI affiliated or not, shall be <br />allowed within the two or three block ribboned area <br />established at DCI's request by the State ABC Board or its <br />agents except those dispensing beer pursuant to and under <br />direction of the ABC Board. <br /> <br /> 2. Vendors using the remaining portion of the mall <br />shall comply with all safety requirements of City Code <br />Section 25-45.1. <br /> <br /> 3. All-vendors shall obtain proper business licenses <br />pursuant to the City Code, and.to the extent necessary, City <br />officials will administer this requirement ..... <br /> <br /> 4. DCI shall obtain liability insurance of at least <br />$1,000,000 per accident insuring the 'Fridays After Five <br />events, name the City as an additional insured under said <br />policy, and present evidence of such coverage to the City <br />Attorneys Office prior to.the first eVent, and shall further <br />indemnify and hold harmless the City from any and all costs <br />and liability resulting from Fridays After Five events. <br /> <br /> 5. There will be compliance with all other applicable <br />Code provisions, including the ~roper electrical codes. <br /> <br /> 6. DCI shall be responsible for all trash removal <br /> <br /> <br />
