Edwards, Mr. Towe, <br />Mr. Vandever. <br /> <br />LEGAL BASIS FOR COMPREHENSIVE PLAN <br /> <br /> Mr. Clyde Gouldman, City Attorney, explained that the <br />physical development portion of the Comprehensive Plan is <br />required by State law to be reviewed and adoPted every five <br />years. Mr. Gouldman stated that the Plan should be general <br />in nature and is used to advise Council on fUture physical <br />development decisions. <br /> <br />LAND USE PLAN <br /> <br /> Mr. GOuldman stated that a public hearing is required to <br />be held by Council on the proposed Comprehensive Plan and if <br />Council amends the Plan it must be sent back to the Planning <br />Commission for their review prior to final adoption by City <br />Council. Mr. Gouldman stated that prior to making changes <br />to the Comprehensive Plan Council should consider the <br />following: 1) What are the objectives behind the proposed <br />changes? 2) Does Council agree with those objectives? and <br />3) Are the objectives accomplished by the proposed changes? <br /> <br /> Mr. Craig Brown, Deputy City Attorney, discussed the <br />issue of downzoning and recommended that in order to be <br />legally defensible there needed to be consistency in the <br />existing zoning and the proposed Plan. Mr. Brown stated that <br />the major change in classification recommended was to create <br />a new R-lA (single family) zone. Mr. Brown stated that as <br />many as 5,000 parcels of land Could be affected by zoning <br />changes, many of them by downzoning. It was pointed out that <br />creating the new single family zone would not autOmatically <br />downzone property. Mr. Brown stressed that it was important <br />when rezoning to be comprehensive and to be able to justify <br />the change. <br /> <br /> Mr. Huja reviewed the areas propOsed for a change of <br />zoning in the Comprehensive Plan and listed the following <br />criteria used for recommending ch~anges: 1) if the zoning was <br />R-1 no changes were recommended; 2) the present use of the <br />area was considered; 3) it was felt that single family zoning <br />should be distributed throughout the City; 4) single family <br />zoning should exist in all socio-economic areas of the City; <br />and 5) the lot size was conSidered. <br /> <br /> <br />
