240 <br /> <br />consideration. <br /> <br /> Responding to a question from Ms. Slaughter, Mr. Hendrix <br />stated that ~only one bid had been received and the contract <br />had been awarded to Nowell's Catering. <br /> <br /> Ms. Slaughter recommended that the staff request that <br />the food service contractor take steps to reduce the amount <br />of garbage generated and also request that products such as <br />styrofoam not be used. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Hendrix <br />stated that any excess funds are returned to the State. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR SORORITY AT 1718 <br />JEFFERSON PARK AVENUE AND 106 MAYWOOD LANE <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that the Planning Commission recommended approval of <br />the special permit for the following reasons: 1) The use is <br />compatible with surrounding uses in the area; 2) The use, as <br />proposed, will not have a significant adverse impact on the <br />surrounding neighborhood if conditions are met; and 3) The <br />density of the use, as proposed, is comparable to the density <br />of the R-2 zone and is thus in harmony with the Comprehensive <br />Plan. Mr. Huja noted that six apartments would be allowed by <br />right on the property. <br /> <br /> Ms. Slaughter stated that she felt the requirement of a <br />house mother on site was an important aspect of the special <br />permit. <br /> <br /> Rev. Edwards questioned the total number of residents <br />which woutd ~be allowed on the property by right and Mr. Huja <br />replied that up to forty residents could be allowed if the <br />property was rebuilt and if parking requirements could be <br />met. <br /> <br /> Responding to a question from Rev. Edwards, Mr. Huja <br />stated that to the best of staff's knowledge a sorority was <br />operating on the property without approval. <br /> <br /> Rev. Edwards stated that he would like to put a time <br />limit of five years on the special permit if legally allowed. <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that time <br />limits have never been applied to special permits and the <br />City Code states that a special permit continues with the <br />property as long as the use is the same. Mr. Gouldman noted <br />that the zoning administrator oversees the permit and could <br />revoke the permit if violations occur and he therefore could <br />not recommend that a time limit be placed on the special <br />permit. <br /> <br /> Rev. Edwards stated that he would only support the <br />special permit With the addition of a time limit. <br /> <br /> Mr. Toscano asked Rev. Edwards what kinds of issues <br />would cause him concerns and Rev. Edwards replied the use of <br />illegal drugs and underage drinking. <br /> <br /> Ms. Slaughter added that she would be concerned if there <br />were violations of the meal requirements and noted that it <br />concerned her that the sorority had operated illegally prior <br />to seeking the special permit. <br /> <br /> Mr. ToScano noted that the special Permit could be <br />revoked at any time that violations are found. <br /> <br /> Responding to a question from Ms. Slaughter, Mr. <br />Gouldman stated that the special permit was not transferrable <br />to another sorority as written, unless the sorority complied <br />with this sorority's regulations. <br /> <br /> <br />
