289 <br /> <br /> Councilors requested that staff give options for an <br />appeal to Council as well as the City Manager for them to <br />consider. <br /> <br /> Mr. Chapman stated that expansion of the Pen Park golf <br />course is ahead of schedule and employees will need to be <br />hired to maintain the course. <br /> <br /> On motion by Ms. Slaughter, seconded by Mr. Toscano, <br />Council unanimously voted to meet in executive session to <br />discuss personnel matters; use, sale or purchase of publicly <br />owned property, sPecifically the CSX site; and for the <br />purpose of consultation with legal counsel concerning matters <br />pertaining to actual or probable litigation or other matters <br />requiring legal advice, as authorized by Section 2.1-344(a) <br />(1), (3), and (7) of the Freedom of Information Act. <br /> <br /> Council reconvened in open session and, on motion by Ms. <br />Waters, seconded by Ms. Slaughter, unanimously certified <br />that, to the best of each member's knowledge, (i) only public <br />business matters lawfully exempted from open meeting <br />requirements by Virginia law were discussed in the executive <br />meeting to which this certification resolution applies, and <br />(ii) only such public business matters as were heard, <br />discussed or considered by the City Council. <br /> <br />President ~ ' Ci~ · - ~ / <br /> <br />COUNCIL CHAMBER - September 16, 1991 <br /> <br /> Council met in regular session on this date with the <br />following members present: Rev. Edwards, Ms. Slaughter, Mr. <br />Toscano, Mr. Vandever, Ms. Waters. <br /> <br /> On motion by Ms. Waters, seconded by Ms. Slaughter, the <br />minutes of the September 3rd meeting were unanimously <br />approved as presented. <br /> <br />PUBLIC <br /> <br /> Mr. Eric Barber of 1209 St. George Avenue, stated that <br />the City had installed a catch basin in the yard two <br />houses up from his property and his immediate neighbor plans <br />to hook intO this basin and direct water onto his property. <br />Mr. Barber requested that Council develop guidelines for <br />future drainage projects to avoid diverting water onto <br />adjacent properties. <br /> <br /> Mr. Hendrix stated that the catch basin had been <br />provided as part of the neighborhood drainage program, with <br />the property owner providing 25% of the cost. Mr. Barber's <br />immediate neighbor chose to pay the entire cost of the <br />improvements himself and others must get on the waiting list <br />until funding is available. <br /> <br /> Ms. Waters stated that she felt Council should look into <br />the affect drainage improvements have on adjacent properties <br />in a future work session. <br /> <br /> Mr. Gouldman stated that State law allows storm water to <br />be reasonably diverted by property owners, but added that the <br />neighbor who paid 100% of the cost of the project must stop <br />the improvements short of the property line and install rip <br />rap to minimize the impact on Mr. Barber's property. <br /> <br /> Mr. Barber expressed concern that the easements which <br />were approved in the old subdivision plans were being <br />changed. <br /> <br /> <br />
