58 <br /> <br />the following: That the use be limited to a research and <br />laboratory facility only and not have more than a moderate <br />adverse impact on the surrounding area as determined by the <br />City. <br /> <br /> Mrs. Gleason recommended that the research lab comply <br />with all local regulations in addition to state and federal. <br /> <br /> Mro Blake Hurt, representing Rivanna Partners, owners <br />of the property, stated that the tenant may occupy more than <br />10,000 square feet, though only that amount would be used as <br />a research lab. <br /> <br /> Mr. Buck stated that the special permit was not needed <br />for office space. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />Council approved the resolution granting a special permit <br />to use 855 W. Main Street as a research lab, with Mr. Barnes <br />abstaining due to a potential conflict of interest. <br /> <br /> WHEREAS, Rivanna Partners has requested a special use <br />permit to use the old Safeway Building at 855 West Main <br />Street for a lab which will do research into new drugs for <br />medical treatment) <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on January 12, 1988, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special use permit is <br />hereby granted to allow Rivanna Partners to use the building <br />located at 855 West Main Street for a research lab. This <br />property is further identified on City Real Property Tax Map <br />#31 as Parcels 169 and 170, having approximately 400 feet of <br />frontage on West Main Street and containing approximately <br />107,288 square feet of land or 2.46 acres. <br /> <br /> This special use permit is subject to the following <br />conditions: <br /> <br /> 1. The use shall be limited to a research and <br />laboratory facility only and will not occupy more than 10,000 <br />square feet in area. <br /> <br /> 2. There shall be no more than a moderate adverse <br />impact on surrounding properties, as determined by the City <br />Council in consultation with the Planning Commission, in the <br />form of smoke, odor, dust, noise, gas, fumes, fire hazards, <br />traffic, water and air pollution, and toxic waste disposal. <br /> <br /> 3. There shall be ongoing compliance with all local, <br />state and federal regulations and permit requirements, <br />including, but not limited to, those governing water and air <br />quality and toxic waste disposal. <br /> <br />APPROPRIATION: $32,507 - TRANSPORTATION PLANNING GRANT <br /> <br /> Mr. Hendrix stated that the appropriation included <br />$17,149 in Federal Highway Administration funds, $9,866 in <br />Urban Mass Transportation Agency funds, $2,746 in Virginia <br />Department of Highways and Transportation funds, and $2,746 <br />in City funds which will be used for transportation planning <br />activities in the southern section of the City. <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, the <br />$32,507 appropriation for the Transportation Planning Grant <br />was offered and carried over to the next meeting for <br />consideration. <br /> <br /> <br />
