<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />RESOLUTION<br /> <br />APPROVING THE ACQUISITION OF LAND<br /> <br />ON 8th STREET LANE AND PAGE STREET<br /> <br />FOR PASSIVE PARK PROJECT<br /> <br />WHEREAS, the Norfolk Southern Railway Company (the “Railroad”), the owner of land on Page <br />Street and 8th Street Lane, identified on the attached review plat as Parcels A and B, hereinafter the <br />“Property”, has indicated a willingness to convey the Property to the City of Charlottesville for creation <br />of a passive park to serve the 10th and Page Street neighborhood; and <br />WHEREAS, the Railroad has agreed to convey to the City the Property for the purchase price of <br />$60,800.00; and <br />WHEREAS, funds are available for the purchase and development of these parcels through the <br />Community Development Block Grant program; and <br />WHEREAS, the Department of Neighborhood Development Services seeks the endorsement of <br />City Council to proceed with the purchase of the above-described land at a purchase price of $60,800.00, <br />with funding supplied through the CDBG Fund; and <br />WHEREAS, an Agreement for the conveyance of said land has been reviewed and approved by <br />the City Attorney’s Office; now, therefore, <br />BE IT RESOLVED, by the Council of the City of Charlottesville that it hereby authorizes the <br />purchase of the above-described Property on 8th Street Lane and Page Street for creation of a passive park <br />to serve the 10th and Page Street neighborhood. The City Manager is hereby authorized to execute the <br />above-referenced Agreement, and the Mayor is hereby authorized to sign a deed of conveyance, both in <br />form approved by the City Attorney or his designee. The City Attorney’s Office shall take whatever <br />actions are necessary to effect the acquisition of the above-described Property, pursuant to the terms and <br />conditions set forth in the aforementioned Agreement.
