342 <br />THE CITY MANAGER REPORTED THAT THE CITY HAD BEEN SERVED WITH A MOTION OF <br />DECLARATORY JUDGMENT CONCERNING THE HOUSE REFERENDUM BILL. MR. BOWEN STATED <br />THAT THE CITY ATTORNEY COULD NOT DEFEND THE SUIT SINCE HE HAD MADE A PUBLIC <br />MATTER RE: DECLARATORY APPEARANCE IN OPPOSITION TO THE BILL AND PERSONALLY BELIEVED IT UNCONSTITUTIONAL. <br />JUDGMENT - HOUSE REFERENDUM <br />BILL, MR, BOWEN FURTHER STATED THAT HE HAD CONTACTED MR. GEORGE GILMER AND DISCUSSED <br />RETAINING HIM ON BEHALF OF THE CITY TO DEFEND AGAINST THE SUIT. MR. GILMER <br />AGREED TO REPRESENT'YHE CITY SUBJECT TO APPROVAL OF HIS APPOINTMENT BY THE <br />COUNCIL. MR. BOWEN RECOMMENDED THAT MR. ~aILMER BE SO APPOINTED. ON MOTION <br />BY MR. DAVIS, SECONDED BY MR. COLEMAN, MR. DAVIS, MR. MICHIE, MR, SGRIBNER AND MR, WEINBERG. <br />ABSENT: NONE. <br />THE MINUTES OF THE MEETINGS OF MAY 18, 1959 AND MAY 27, 1959 WERE READ <br />AND APPROVED. <br />MR. E. R. SLAUGHTER ADDRESSED THE COUNCIL TO REQUEST FUNDS FOR THE OPERATION <br />OF THE REDEVELOPMENT AND HOUSING AUTHORITY OFFICE. MR. SLAUGHTER STATED THAT THE <br />P. H. A. FUNDS HAD BEEtJ CUT OFF EFFECTIVE MAY 31, 1959 PENDING CLARIFICATION OF <br />MATTER RE: OPERATING FUNDS <br />REDEVELOPMENT 8c HOUSING THE HOUSING REFERENDUM BILL AND THAT THE U. R. A. FUNDS WOULD PAY ONE-HALF THE <br />AUTHORITY OFFICE <br />COST OF THE OFFICE OVERHEAD. HE REQUESTED THE COUNCIL TO APPROPRIATE $650.00 <br />PER MONTH FOR THE NEXT THREE MONTHS TO TAKE CARE OF THE OTHER ONE-HALF OF THE <br />OPERATING EXPENSES. ON MOTION BY MR. DAVIS, SECONDED BY MR. WEINBERG, THE <br />FOLLOWING RESOLUTION WAS UNANIMOUSLY ADOPTED: <br />APPROPRIATION: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE <br />REDEVELOPMENT & HOUSING <br />AUTHORITY OFFICE THAT $1,950.00 BE AND THE SAME IS HEREBY APPROPRIATED IN ACCORDANCE <br />WITH THE FOREGOING REQUEST. <br />A COMMUNICATION WAS PRESENTED FROM MR.
