Appointments to Boards and Commissions. <br /> <br />4. <br /> <br /> Executive session to discuss disposition of public property <br /> as exempted by Section 2.1-344(a)(1) of the Virginia Freedom <br /> of Information Act. <br />BY ORDER OF THE MAYOR BY ~ ~ <br /> Cler <br /> <br />BASEMENT CONFERENCE ROOM May 31, 1983 <br /> <br /> Council met in special session this date at 9:05 p.m. with the <br />following members present: Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. <br /> <br />Hall. Absent: Mr. Conover. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, Mr. Gary <br />O'Connell was appointed temporary clerk. The motion was unanimously <br />approved. <br /> <br /> Mrs. Gleason moved, Dr. Gunter seconded, and the following <br />resolution was unanimously adopted: <br /> <br /> WHEREAS, the Charlottesville Redevelopment and Housing Authority <br />(the "Authority") has considered the application of Milgraum <br />Associates (the "Company") for the issuance of the Authority's Revenue <br />Bond in the principal amount of $800,000 (the "Bond") to assist in <br />the financing of the Company's acquisition, renovation and equipping of <br />a 22,000 square foot office building (the "Facility") in Charlottesville, <br />Virginia, and has held a public hearing thereon on May 31, 1983; and <br /> <br /> WHEREAS, the Authority has requested the City C~uncil (the "Council") <br />of Charlottesville, Virginia, (the "City"), to approve the mssuance of <br />the Bond to comply with Section 103(t) of the Internal Revenue Code of <br />1954~ as amended; and <br /> <br /> g~EREAS, a copy of the Authority's resolution approving the issuance <br />of the Bond, subject to the terms to be agreed upon and a record of the <br />public hearing has been filed with the Clerk of the Council; <br /> <br /> BE IT RESOLVED by the City council of the City of Charlottesville, <br />Virginia: <br /> <br /> (1) The Council of the City of Charlottesville, Virginia, approves <br />the issuance of the Bond by the Charlottesville Redevelopment and <br />Housing Authority for the benefit of Milgraum Associates to the extent <br />required by Section 103(k) of the Internal Revenue Code, to permit the <br />Authority~to assist in the financing of the Facility. <br /> <br /> (2) The approval of the issuance of the Bond, as required by <br />Section 103(k) does not constitute an endorsement of the Bond or the <br />creditworthiness of the Cpmpany, but, as required by Section 15.1-1380 <br />of the Code of Virginia of 1950, as amended, the Bond shall provide <br />that neither the City nor the Authority shall be obligated to pay the <br />bond or the interest thereon or other costs incident thereto except from <br />the revenues and monies pledged therefor, and neither the faith or <br />credit nor the taxing power of the Commonwealth, the City, or the <br />Authority shall be pledged thereto. <br /> <br />(3) This Resolution shall take effect immediately upon its adoption. <br />Dr. Hall left the meeting at 9:t0 p.m. <br /> <br /> Mr. Robert Sheets, Director of Finance, and Mr. Robert Cox, Assistant <br />Director of Social Services, addressed Council regarding the proposed <br />Charlottesville Gas Assistance.Program.
