RESOLUTION: <br />AUTHORIZING <br />CONDEMNATION TO <br />OBTAIN EASEMENT <br />ACROSS PROPERTY <br />ADJACENT TO <br />RIVANNA RIVER <br /> <br /> S. The approval of~th.e iss~Ce'0f the.~Bonds, as required by Section <br /> 103(k) of the COde and Section 15.1-1378.1 of the Act, does not <br /> constitute an endorsement to a prospective purchaser of'the Bonds of the <br /> creditworthiness of the Project or of the Applicant. <br /> <br />4. This Resolution shall take effect 'immediately upon its adoption. <br />Mr. Wiley explained that the owner of the property had.been offered <br />and refused the fair market value of the land which was needed in order <br />for the City to proceed with sanitary sewer and drainage improvement <br />projects. Therefore, authorizing condemnation Of the property was necessary. <br /> <br /> ~Mr. Conover moved, Mrs. Gleason seconded, and the following resolution <br />was unanimously approved: <br /> <br />267 ' <br /> <br /> WHEREAS, the City of Charlottesville, Virginia needs to obtain <br /> permanent easements and rights-of-way to construct, replace, maintain <br /> and repair a sanitary slewer line across a-portion of a. lot identified <br /> as Parcel 144 on City Real Property Tax Map 50, and to widen, reroute <br /> and maintain a drainage'channel across a portion of the 'same lot located <br /> within the City limits off East High Street; and <br /> <br /> WHEREAS, consent to the purchase of the-property and easements <br /> necessary for the project cannot be obtained; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Charlottesville, Virginia, that a public necessity is hereby declared to <br /> exist for the acquisition of permanent easements and rights-of-way across <br /> Parcel 144 on City Real Property Tax Map S0 in Order to proceed with <br /> sanitary sewer and drainage mmprovement projects; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, <br /> Virginia that the City Attorney be and hereby 'is directed to institute <br /> condemnation~proceedings for the acquisition of the permanent easements <br /> and rights-of-way across a portion of Parcel 144 on City Real Property <br /> Map S0 and to file the necessary documents with the-Circuit Court for <br /> the City of Charlottesville as provided'~in Sections 15.1-898 and 15.1-899 <br /> of the Code of'Virginia (1950), as amended, and Sections 41 and S0.1 of <br /> the Charter of the City of Charlottesville, Virginia. <br />RESOLUTION: Mr. Wiley stated that Mr. John Via owner of the proper.tv on Harris <br />AUTHORIZING ' · <br /> <br />CONDEMNATION TO Road, had refused the offer of fair market value and condemnation was <br />OBTAIN EASEMENT <br />FOR SIDEWALK ON' necessary in order to proceed with a street widening and.sidewalk installation <br />HARRIS ROAD <br /> project~ <br /> <br /> Mr.. Via stated' his opposition to the condemnation because he did not <br />want a sidewalk fronting his property. <br /> <br /> Dr. Hall moved, Mr. Conover seconded, and the following resolution was <br />unanimously approved by Council: <br /> <br /> WHEREAS, the City of Charlottesville, Virginia needs to acquire <br />property and obtain construction easements to build concrete retaining <br />walls mn connection with a street widening and sidewalk installation <br />project across a portion of three lots designated as Parcels 20, 21 and <br />22 on City Real Property Tax Map 2lB and located w~thin the City limits <br />on Harris Road; and <br /> <br /> WHEREAS, consent to the purchaSe of the property and easements <br />necessary for the project cannot be obtained; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a public necessity is hereby declared <br />to exist for the acquisition of property and construction easements <br />across Parcels 20, 21 and 22 on City Real Property Tax Map 2lB in <br />Order to proceed with a street widening and sidewalk installation <br />project; and <br /> <br />RESOLUTION: <br />$1,soo,ooo <br />BOND ANTICIPATION <br />NOTES GAS <br />SYSTEM <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, <br /> Virgini-a that the City Attorney be and hereby is directed to institute <br /> condemnation proceedings for the acquisition o.f property and easements <br /> across a portion of Parcels 20, 21 and 22 on City Real Property Tax <br /> Map 2lB and to file the necessary documents with the Circuit Court <br /> for the City of Charlottesville ~s provided in Sections 15.1-898 and <br /> 15.1-899 of the Code of Virginia (1950), as amended, and Sections 41 and <br /> 50.1 of the Charter of the City of Charlottesville, Virginia. <br /> <br /> Mr. Hendrix introduced the RESOLUTION MAKING CERTAIN FINDINGS CONCERNING <br /> THE PROPOSAL SUBMITTED FOR THE PURCHASE OF ONE MILLION FIVE HUNDRED THOUSAND <br /> DOLLARS ($1,S00,000) PRINCIPAL AMOUNT OF GENERAL OBLIGATION GENERAL <br /> IMPROVEMENT.BOND ANTICIPATION NOTES OF THE CITY OF CHARLOTTESVILLE <br /> <br />. VIRGINIA'; ACCEPTING THE PROPOSAL TO PURCHASE SUCH NOTES; FIXING THE RATE <br /> <br /> OF INTEREST TO BE BORNE BY SUCH NOTES; AND APPROVING THE FORM OF SUCH NOTES. <br /> <br /> <br />
