ORDINANCE: <br />SURCHARGE FOR <br />WATER <br />CONNECTIONS <br />(2nd reading) <br /> <br />OTHER BUSINESS <br /> <br />PUBLIC <br /> <br /> Mrs. Gteason seconded the motion to amend, and stated that she felt <br /> that many people would appreciate the opportunity to pay back the City. <br /> <br /> The amendment to the ordinance was approved by the following vote. <br /> Ayes: Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: Mr. Buck. <br /> <br /> On a question from Mr. Buck concerning the additional $S,000 income <br /> exemption for disabled persons, Ms. Linda PeacoCk, Budget Analyst, stated <br /> that the numbers and costs related to this exemption were very low. <br /> <br /> Mr. Buck indicated his intention to.vote for the ordinance even <br /> though he did not agree with the amendment. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION <br />10-36, 10-38 THROUGH 10-41, 30-9, AND 30-11 THROUGH 30-13 OF THE CODE OF <br />THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, AS AMENDED, TO INCREASE THE <br />ELIGIBILITY OF THE ELDERLY AND HANDICAPPED FOR REAL ESTATE TAX RELIEF AND <br />RENT RELIEF BY INCREASING INCOME AND NET WORTH LIMITS AND BY ADDING AN <br />EXEMPTION FOR DISABILITY INCOMEV as amended, was approved by the following <br />vote. Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. GUnter, Dr. Hall. <br />Noes: None. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 29, <br /> AS~AMENDED, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, BY ADD%NG <br /> A SECTION NUMBERED 29-1.1 RELATING TO THE SURCHARGE ON NEW WATER SERVICE <br /> CONNECTIONS TO PROVIDE REVENUES FOR THE BUCK MOUNTAIN RESERVOIR" which was <br /> offered atl-the November 21 meeting, was approved by the following vote. <br /> <br />Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr.~ Gunter, Dr. Hall. Noes: None. <br /> <br /> Mr. Wiley presented a resolution which would authorize retention of and <br />payment for counsel for defense of the Vinegar Hill suit. <br /> <br /> Dr. Hall moved the Resolution Authorizing the Retention of Special Legal <br />Counsel, Mrs. Gleason seconded, and it was unanimously approved by Council. <br /> <br /> WHEREAS, the Council has been served with a Motion for Judgment in <br />a lawsuit styled Martin H. Dehaan, et al.. v. City of Charlottesville, et al. <br />pending in the Circuit Court for the City of Charlottesville (Case No. 2929) <br />challenging, among other matters, the. ordinance of October 27, 1983, authorizing <br />the ~ssuanee of $9.S million in general obligation bonds and bond anticioation <br />notes, the proceeds of which are to be appropriated to the CharlottesvilLe <br />Redevelopment and Housing Authority (CRHA) for use in the Vinegar Hill Re- <br />development Project; and ' <br /> <br /> WHEREAS, on advice of the~City Attorney, the Council has determined <br />that the public interest requires that the firm of Little, Parsley and <br />Cluverius of Richmond, virginia, who have previously been retained as special <br />counsel to the City"and CRHA, be retained as defense counsel in this litigation. <br />now therefore be it ~ , <br /> <br /> RESOLVED, by the Council of the City of Charlottesville, Virginia that <br />the City Attorney ~s authorized and directed to retain the firm of Little, <br />Parsley and Ctuverius, at the-firm's usual and customary hourly rates, for <br />the defense of the City and the Council in the case of Martin H. Dehaan, et al. <br />v. City of Charlottesville, et al. and related matters, i~ding such expert <br />~itnesses or other ancillary services as may be required, and further including <br />the filing of any counterclaims, cross-claims or' third party motions the <br />City Attorney deems advisable; and be it further <br /> <br /> RESOLVED, that CRHA is requested and authorized to pay the expenses <br />of this litigation from the account of the Vinegar Hill Project, including <br />funds t~ansferred to that account from the Garrett Street Redevelopment <br />Project account pursuant to previous action of this Council. <br /> <br /> Mr. Richard Pleasants of 1701 Rosser Avenue requested that his <br />personal property ~tax be adjusted because he had paid $1,000 for his vehicle <br />and it was assessed at $2,62S. <br /> <br />Mr. Buck stated that staff was studying the matter and would contact <br /> <br />him. <br /> <br /> On mo~tion by-Mr. Conover, seconded by Dr. Gunter, Council unanimously <br />voted to go into executive session to discuss personnel and legal matters as <br /> <br /> <br />
