348 <br /> <br />APPROPRIATION: <br />$6,586 <br />CHARTER HOUSE <br /> (2nd reading) <br /> <br />RESOLUTION: <br />AUTHORIZING CON- <br />DEMNATION PRO- <br />CEEDINGS TO <br />ACQUIRE EASEMENTS <br />AT INTERSECTION <br />OF CAROLINE & <br />FAIRWAY AVE. <br /> <br />ORDINANCE: <br />ADJUSTMENT OF <br />SPEED LIMIT ON <br />AVON ST. <br /> (2nd reading) <br /> <br />OTHER BUSINESS <br /> <br /> The $6,586 appropriation to Charter House which was offered <br />at the meeting of March 19th was approved by the:following vote. <br />Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. <br /> <br />Noes: None. <br /> <br /> ~HEREAS, the grant award from the Department of Criminal <br />Justice Services for the operation of Charter House, a shelter <br />for homeless alcoholics, by the Region X Community Services Board, <br />was significantly reduced for FY 83-84; and <br /> WHEREAS, Charter House requested.'$15,890 to allow operation <br />through FY 83-84,.and City Council advised on October 17, 1983 <br />that Charter House appeal for contributions from the community <br />and submit a final request for City funds after such appeal; and <br /> WHEREAS, Charter House has received '$9,304 in contributions <br /> from the community as of March 19, 1984; NOW, THEREFORE <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the sum of $6,586 is hereby appropriated from the <br />General Fund to expenditure account 11-12240 for the continued <br />operation of Charter House by the Region X Community-Services <br />Board during the remainder of FY 83-84. <br /> <br /> Mr. Wiley stated that Council had formerly approved an easement <br /> for sewer lines, but the Department of Public Works had foUnd that <br /> storm drainage improvements were now needed. Mr. Wiley added that <br /> the owners of the land had been approached and had refused the offer <br /> <br />of fair market value. <br /> On motion by Dr. Gunter, seconded by Dr. Hall, the resolution <br />authorizing condemnation proceedings to acquire easements at the <br />intersection of Caroline and Fairway Avenue was unanimously approved <br /> <br />by Council. <br /> WHEREAS, the City of Charlottesville, Virginia needs to obtain <br />a.permanent easement and right-of-way to widen, reroute and <br />maintain a drainage channel across a portion of a lot identified as <br />Parcel 143.1 on City Real Property Tax Map 50, within the City <br />limits at the intersection of Caroline and Fairway Avenues; and <br /> WHEREAS, consent to the purchase of the easement and right-of- <br />way necessary for the project cannot be obtained;. <br /> NOW,~ THEREFORE, BE IT RESOLVED by the Council of the City of <br />charlottesville, Virginia, that a public necessity is hereby <br />declared to exist for the acquisition of a permanent easement and <br />righ,t-of-way across the lot designated as Parcel 143.1 on City Real <br />Property Tax Map 50 in order to proceed with a City drainage project; <br />and <br /> BE IT FURTHER RESOLVED by the Council of the City of <br /> Charlottesville, Virginia that the City Attorney .be and hereby is <br /> directed to institute condemnation proceedings for the acquisition <br /> of the permanent easement and right-of-way across a portion of the <br /> lot designated as Parcel 143.1 on City Real Property Tax Map 50 and <br /> to file the necessary documents with the Circuit Court for the City <br /> of Charlottesville as provided in Sections 15.1-898 and 15.1-899 of <br /> the Code of Virginia (1950), as amended, and Sections 41 and 50.1 <br /> of the Charter of the City of Charlottesville, Virginia. <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> SECTION 1609 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br /> RELATING TO MINIMUM AND MAXIMUM SPEED LIMITS," which was offered at <br /> the meeting of March 19th, was approved by the following vote. Ayes: <br /> Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. <br /> Mrs. Gleason moved and read a resolution congratulating the <br /> University of Virginia Cavalier basketball team for their successful <br /> season. Dr. Hall seconded the motion and it was unanimously approved <br /> <br />by Council. <br /> <br /> WHEREAS, the Cavaliers began their 1983-84 basketball season <br />by continuing their winning tradition, and <br /> WHEREAS, through a season for successes and disappointments <br />the Cavaliers never gave up, and <br /> <br /> <br />
