3621 <br /> <br />ORDINANCE: <br />AMENDING AND <br />IMPOSING SPEED <br />LIMIT ON AVON <br />ST., INDIA RD., <br />LINE DR., <br />MONTICELLO-AVE., <br />SEMINOLE CT. & <br />ZAN RD. <br /> (2nd reading) <br /> <br />ORDINANCE: <br />CLOSING A <br />PORTION OF <br />ST. CLAIR AVE. <br />FROM POPLAR TO <br />SYCAMORE <br /> <br />OTHER BUSINESS <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />that the Mayor is hereby authorized to execute on behalf of the <br />City the following document, in form approved by the City Attorney: <br /> <br />Special Warranty Deed among Bernice Hodock, the University <br />of Virginia and the City of Charlottesville granting <br />easement in connection with Montebello Alley. <br /> <br /> A copy of such document shall be kept on fiIe with the minutes <br />of the Council meeting at which this resolution was adopted. <br /> <br />The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> <br />SECTION 16-9 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br /> <br /> "which was offered <br />RELATING TO MINIMUM AND MAXIMUM SPEED LIMITS, ' <br /> <br />on April 16th was approved by the following vote. Ayes: Mr. Buck, <br /> <br />Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. <br /> <br /> Mr..Wiley stated~that a petition had been received requesting <br /> <br />the closing of a portion fo St. Clair from Sycamore to Poplar., that <br />viewers had been appointed, and their reports had been received. <br />Mr. Wiley added that a letter had been received opposing the closing <br />on the grounds that it would set a precedent for another portion of <br />St. Clair and .an offer had been made to purchase.the-street. <br /> Mr. John Pratt addressed Council, stating his desire to purchase <br />the property in question. <br /> Mr. Ed Travis stated his support of ~the street closing and his <br /> desire that ~he property revert to the adjacent propertyowners as <br /> is the normal practice. <br /> <br /> Mr. Southall, the author of the letter opposing the closing, <br /> <br /> stated his fear that the portion of St. Clair in his block would be <br /> closed, thereby eliminating the only entrance into his property. <br /> Mr. Hendrix stated that if a street were put in, it would be a <br /> detriment to the existing neighborhood. <br /> <br /> Mrs. Southall also spoke opposing her block being closed. <br /> Mr. Buck reassured Mrs. gouthatl that as long as adjoining <br /> property owners opposed a street closing, the street would not be <br /> closed. <br /> <br /> In response to Mr. Pratt's request to purchase the property, <br /> <br /> Mr. Wiley stated that even if the City chose to sell the property, <br /> the City may only own the right of way for the land and not the fee <br /> simple. <br /> <br /> Mr. Buck stated that Mr. Pratt could further explore his purchasing <br /> of the property before the second reading of the ordinance if he <br /> desired, but questioned whether it would be fair or right for Council <br /> to sell the property rather than having it revert to the adjoining <br /> property owners. <br /> On motion by Mr. Conover, seconded by Mrs. Gleason, the ordinance <br /> entitled "AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION <br /> OF ST. CLAIR AVENUE" was offered and carried over to the next meeting <br /> for consideration. <br /> Mr. Hendrix stated that a request had been received from Barracks <br /> Road Shopping Center to purchase land to-be used as a loading dock. Mr. <br /> Hendrix added that this would not infringe on the street right of way. <br /> <br /> <br />
