368 <br /> <br />APPROPRIATION: <br />$1,509,234.00 <br />JOB TRAINING & <br />PARTNERSHIP ACT <br />PROGRAM. <br /> (2nd reading) <br /> <br />RESOLUTION: <br />AUTHORIZING <br />RELEASE TO <br />RECEIVE SUPPLE- <br />MENTAL GRANT <br />FOR 1983-84 <br />BASIC SCHOOL <br />AID <br /> <br />RESOLUTION: <br />AMENDING <br />COOPERATION <br />AGREEMENT WITH <br />HOUSING <br />AUTHORITY <br /> <br /> The $1,509,234.00 for the Job Training Partnership Act Program <br />which was offered at the meeting of May 7th was approved by the <br />following vote~ Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. <br />Gunter, Dr. Hall. Noes: None. <br /> BE IT RESOLVED by .the Council of the City of Charlottesville, <br />Virginia, that the Director of Finance is authorized to. create a <br />special fund designated as the Job Training Partnership Act Fund, <br />and that the sum received from the Employment and Training Division <br />of the Commonwealth of Virginia pursuant to such Act, estimated at <br />$1,509,234.00 is hereby appropriated to such fund, to be expended <br />on authorization from the City Manager or his designee, and in <br />accordance with applicable state and federal laws and regulations, <br />to carry out the purposes of the Act. <br /> Mr. Hendrix stated that the State had requested Council <br /> approval of the resolution which authorized the Mayor to sign a <br /> release agreeing that the City will accept the $181,062.00 to <br /> correct an error made by the State, and will not sue the State for <br /> additional funds resulting from the error. Mr. Hendrix added that <br /> <br />staff recommended approval. <br /> On motion by Dr. Hall, seconded by Dr. Gunter, the resolution <br />authorizing the release to receive supplemental grant for 1983~84 <br />basic school aid was unanimously approved by Council. <br /> WHEREAS, errors i.n calculation of the state basic school aid <br />formula have resulted in underpayments to Charlottesville and <br />certain other localities for the 1983-84 school year and prior <br />years; and <br /> WHEREAS, the General Assembly has appropriated funds for a <br /> one-time supplemental grant .(in the amount of $181,054 for <br /> Charlottesville) to such localities in partial compensation for <br /> such underpayments; and <br /> <br /> WHEREAS, as a condition of such supplemental grant payment <br /> the State Department of Education is requiring the recipient <br /> localities to release all further claims for such underpayments, <br /> now, therefore <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br /> Virginia that the Mayor is authorized to executive on behalf of <br /> the City a release,-disdharging the Commonwealth, its offi.cials, <br /> agents and employees from further liability for such basic school <br /> aid underpayments upon receipt by the City of the $181,065 supple- <br /> mental grant payment. <br /> <br /> Mr. Wiley, City Attorn.ey, stated that the resolution Would <br /> <br /> set up a contingency plan in the event the City loses the Vinegar <br /> Hill suit in the Supreme Court. The plan would involve the City <br /> acquiring the developer's interest in the project through the <br /> issuance of bonds by the Housing Authority. The developer would <br /> remain committed to completing the project and Radisson would.operate <br /> <br />the hotel. <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the resolution <br />"Authorizing the Mayor to enter into amendment No. 2 to cooperation <br />agreement with Charlottesville Redevelopment and Housing Authority <br />regarding the Vinegar Hill Hotel and Conference Center Project" was <br />unanimously approved by Council. <br /> WHEREAS, the City of Charlottesville ("City") and the Charlottes- <br />ville Redevelopment and Housing Authority ("Authority") entered into a <br />Cooperation Agreement dated October 27, 1983 ("Cooperation Agreement") <br />which sets forth the responsibilities of the CitY and the Authority <br />for the development and financing of the hotel, conference center, <br />corporate training facility and parking deck ("Project"), to be con- <br />structed within the Vinegar Hil. 1 Redevelopment Project; <br /> WHEREAS, the City and the Authority entered into Amendment No. 1 <br /> to the Cooperation Agreemen~t on April 6, 1984 (the Corporation Agreement, <br /> as so amended, is hereinafter referred to as the "Cooperation Agreement"); <br /> <br /> <br />
