FROM <br />R-3 TO B-1. <br />(2nd reading) <br /> <br />ORDINANCE: <br />RELATING TO <br />USES ALLOWED <br />BY RIGHT AND <br />BY SPECIAL <br />PERMIT IN R-3 <br />DISTRICTS AND <br />TOJAPPLICA- <br />BILITY OF' <br />"FAMILY" <br />(2nd reading) <br /> <br />RESOLUTION: Mr. Wiley stated ~hat b~ck~Of'the present favorable short-term <br />$1.S MILLION - <br />BOND ANTICIPA- rates, it was recommended that the'bonds be reissued for an additional <br />TION NOTES - <br />GAS SYSTEM .year. Mr. Wiley stated that the resolution would require two readings <br /> <br /> and that before the second reading the Director of Finance and Treasurer <br /> would n~egotiate the purchaser and rates. <br /> <br /> The resolution was moved by Dr. Hall, seconded by Dr. Gunter and <br /> carried over to the next meeting for consideration. <br /> <br /> The~ordinance entitled ~'AN ORDINANCE AMENDING AND REENACTING THE <br /> DISTRICT MAP INCORPORATED .IN SECTION 31~4 OF THE'ZONING ORDINANCE OF THE <br /> CODE OF THE CITY OF CHARLOTTESVILLE, 1976, BY THE REZONING OF PROPERTY <br /> LOCATED AT $08 TENTH STREET, N.E." which was offered at the meeting of <br /> August 6th was approved by the following vote. Ayes: Mr. Barnes, Mr. <br /> Buck, Dr. Gunter, Dr. Hall. Noes: None. Abstaining: Mrs. Gleason. <br /> <br /> Mr. Wiley reviewed additional amendments to the ordinance relating <br /> <br /> to allowing special permits for units designed for more than four persons <br /> and to the grandfather clause. <br /> <br /> Mrs. Peggy King of 2012 Lewis Mountain Road, stated that she felt the <br /> special permit should be viewed as a privilege not a right and that the <br /> burden of proving that it would not have an adverse effect should be on the <br /> applicant and not on the neighborhood. Mrs. King added that while she was <br /> not enthusiastic about the proposed amendments,- she could accept them. <br /> <br /> Mr. O'Connell stated that the process of identification and enforcement <br /> would require increased staffing. <br /> <br /> Mr. Jim Grigg of 1404 E. Market Street and a partner in a project due <br /> <br /> to begin Which had been approved under the former ordinance but which would <br /> now require a special permit, questioned the effect the change would have on <br /> his project. <br /> <br /> Mr. Steve Clark, Vice~President o.f the Student Council at the University <br /> of Virginia., stated that while he still opposed the ordinance, he was in <br /> favor of the amendmen.ts proposed. <br /> <br /> Mr. Leslie Marshall of ~the University of Virginia Student Council, <br /> stated his support of the proposed amendments. <br /> <br /> Responding to Mr. Grigg's comments, Mr. Wiley stated that the situation <br /> was an unusual one, but that he felt he would still need to go through the <br /> special permit process. <br /> <br /> Dr. Gunter stated her hope that the special permit process could be <br /> speeded up for Mr. Griff. <br /> <br /> Mr. Barnes stated that he felt the ordinance with its proposed amendments <br /> balanced the concerns of all those involved. <br /> <br /> Mr. Barnes moved to apply the ordinance to residential districts only. <br /> Dr. Hall seconded the motion. <br /> <br /> Dr. Gunter stated that she felt the Planning Commission had good reasons <br /> for including the business districts because of their close proximity to <br /> residential areas. <br /> <br /> Mr. Wiley st.ated that he did not feel the rationale for applying the <br /> ordinance in business zones was clear. <br /> <br /> Mr. Buck stated that he opposed the application in business zones as <br /> both a policy matter and because he felt that when people choose to live <br /> adjacent to business districts they expect higher, more intense uses. <br /> <br /> <br />
