Mr. Gaston Fornes, owna~.r o~ ~the piece of landlocked property, stated <br />that he wished to maintain s right ~of way in order to retrieve timber. <br /> <br /> Mr. Barnes suggested possibly maintaining a pedestrian access through <br />the street. <br /> <br /> Mr. Buck assured the petitioners for the street closing that Council <br />had no intention of making the street a thoroughfare but that Council did <br />not have the legal right to grant Mr. Fornes a right of way across private <br />property, though he hoped the neighbors would continue to allow him access. <br /> <br /> Mr. Barnes thanked Mr. Fornes for educating the Council on the matter, <br />but stated he felt a responsibility to listen to the concerns of the City <br />residents. <br /> <br /> Mr. Helweg, one of the petitioners, stated that Mr. Fornes could <br />continue to walk through his property to reach his land. <br /> <br /> Mr. Buck added that having the property on ths tax rolls and making <br />a better use of it, in addition to assuring that no street would be bUilt <br />through were reasons for closing the street. <br /> <br />PUBLIC <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF McBLROY DRIVE" which was offered at the meeting of September l?th <br />was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. <br />Gleason. Noes: Dr. Hall. Absent: Dr. Gunter. <br /> <br /> Two citizens, one mobility impaired, requested that crosswalks be <br />installed on South Street and Water Street to accommodate pedestrians and <br />stated that vehicles many times do not obey the one-way restriction on <br />South Street. <br /> <br /> Mr. Buck stated that the traffic engineer would investigate the crosms- <br />walks and the Police would be asked to increase attention to the-South <br />Street area. <br /> <br /> Mrs. Kay Peaslee stated her support for the Drunk Driving Task Force's <br /> recommendation for impoundment od drivers' licenses becaUse a report had <br /> recently been released which said that three-fourths of persons arrested <br /> for drunk driving were repeat offenders. <br /> <br />OTHER BUSINESS: On motion by Dr. Hall, seconded by Mrs. Gleason the two resolutions <br />RESOLUTIONS: ' <br />APPOINTING VIEWERS appointing viewers to consider a request to close a portion of Park Place <br />TO CONSIDER A <br /> <br />REQUEST FOR THE <br />VACATION OF A <br />PORTION OF PARK <br />PLACE BETWEEN <br />LEE STREET AND <br />LAND ROAD and <br />RESOLUTION: <br />APPOINTING VIEWERS <br />TO CONSIDER A <br />REQUEST FOR THE <br />VACATION OF A <br />PORTION OF 12TH <br />STREET, S.W. <br /> <br />between Lee Street and Lane Road and a request to close a portion of 12th <br /> <br />Street, S.W. were ~unanimously approved by Council. <br /> <br /> WHEREAS, this Council has received a petition requesting vacation <br />of a portion of Park Place between Lee Street and Lane Road for a distance <br />of approximately 400 feet; and <br /> <br /> WHEREAS, it appears to Council that the notice required by Section <br />1S.1-364 of the Code of Virginia (1950), as amended, has been duly <br />advertised; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville that <br />Ms. Mary Jane Haynes, Messrs. ~. J. Copeland and 'H. P. Winn, Jr. report <br />in Writing to Council what inconvenience, if any, would-result from such <br />vacation. <br /> <br /> WHEREAS, this Council has received a petition requesting vacation <br />of 12th Street, S.W. south of Lee Street for a distance of 760 feet' <br />and ' <br /> <br /> WHEREAS, it appears to Council that the notice required by Section <br />15.1=364 of the Code of Virginia (19S0), as amended, has been duly <br />advertised; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville that <br />Ms. Mary Jane Haynes, Messrs. W. J. Copeland and H. P. Winn, Jr. report <br />in writing to Council what inconvenience, if any, would result from <br />such vacation. <br /> <br /> <br />
