460' RESOLUTION: AUTHORIZING SETTLEMENT OF CLAIM AGAINST MEIDINGER, INC. ORDINANCE: REZONING PROPERTY AT 318 AND 320 10th STREET,N.E. FROM R-3 TO B-1 (2nd reading) ORDINANCE: AMENDING ARTICLE II, CHAPTER 10 RELATING TO REAL PROPERTY ASSESSMENTS (2~d reading) ORDINANCE: RELATING TO EXONERATION OF PENALTIES OR INTEREST ON DELINQUENT TAXES (2nd reading) ORDINANCE: RELATING TO INVESTMENT OF CITY RETIREMENT FUNDS (2nd reading) 1. The Council approves the issuance of the Bonds by the Authority for the benefit of the Company, as required by Section 103(k) and Section 15.1-1378.1 of the Virginia Code, to permit the Authority to assist in the financing of the Project. 2. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the Project or the Company. 3. The bonds shall not be issued unless they shall have received an allocation of the State Ceiling (as defined in Executive Order Number 50 of the Governor of the Commonwealth of Virginia, dated August 1, 1984),' and nothing in this resolution shall be construed as any assurance that such allocation will be 'available or, if available, will be made. 4. Pursuant to the limitations contained in the Temporary Income Tax Regulations Section Sf.103-2(f)(1), this Resolution shall remain in effect for a period of one year from the date of its adoption. 5. This Resolution shall take effect immediately upon its adoption. Mr. Hendrix stated that Meidinger, Inc. had supplied incorrect figures to the Retirement Benefits Administrator which resulted in over-payment to a small number of retirees~ Mr. Hendrix stated this resolution would authorize the settlement of the claim. On motion by Dr. Hall, seconded by Mrs. Gleason, the resolution authorizing settlement of a claim against Meidinger, Inc. was unanimously approved by Council. The ordinance entitled "AN ORDINANCE REZONING PROPERTY AT 318 AND 320 10TH STREET, N.E. FROM R-3 TO B-I," wKiC~ was offered at the December 3rd meeting, was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Dr. Gunter, Dr. Hall. Abstaining: Mrs. Gleason. Noes: None. The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN ARTICLE II OF CHAPTER 10 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 (AS AMENDED) TO ADD A NEW SECTION NUMBERED 10-9.1 TO PROVIDE FOR THE ABATEMENT OF REAL PROPERTY ASSESSMENTS ON BUILDINGS WHICH ARE DAMAGED BY FORTUITOUS HAPPENINGS BEYOND THE CONTROL OF OWNERS, AND TO MAKE CERTAIN HOUSEKEEPING AMENDMENTS" which was offered at the meeting of December 3rd, was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. The ordinance entitled "AN ORDINANCE TO AMEND'AND REORDAIN SECTION 10'25 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, RELATING TO EXONERATION OF PENALTIES OR INTEREST ON DELINQUENT TAXES" which was offered at the meeting of December 3rd, was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION 20-16 OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1976), AS AMENDED, RELATING TO THE INVESTMENT OF CITY RETIREMENT COMMISSION FUNDS" which was offered at the meeting of December 3rd, was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None.
