460' <br /> <br />RESOLUTION: <br />AUTHORIZING <br />SETTLEMENT OF <br />CLAIM AGAINST <br />MEIDINGER, INC. <br /> <br />ORDINANCE: <br />REZONING PROPERTY <br />AT 318 AND 320 <br />10th STREET,N.E. <br />FROM R-3 TO B-1 <br />(2nd reading) <br /> <br />ORDINANCE: <br />AMENDING ARTICLE <br />II, CHAPTER 10 <br />RELATING TO <br />REAL PROPERTY <br />ASSESSMENTS <br /> (2~d reading) <br /> <br />ORDINANCE: <br />RELATING TO <br />EXONERATION OF <br />PENALTIES OR <br />INTEREST ON <br />DELINQUENT <br />TAXES <br /> (2nd reading) <br /> <br />ORDINANCE: <br />RELATING TO <br />INVESTMENT OF <br />CITY RETIREMENT <br />FUNDS <br />(2nd reading) <br /> <br /> 1. The Council approves the issuance of the Bonds by the <br />Authority for the benefit of the Company, as required by Section <br />103(k) and Section 15.1-1378.1 of the Virginia Code, to permit the <br />Authority to assist in the financing of the Project. <br /> <br /> 2. The approval of the issuance of the Bonds does not <br />constitute an endorsement to a prospective purchaser of the Bonds <br />of the creditworthiness of the Project or the Company. <br /> <br /> 3. The bonds shall not be issued unless they shall have <br />received an allocation of the State Ceiling (as defined in <br />Executive Order Number 50 of the Governor of the Commonwealth <br />of Virginia, dated August 1, 1984),' and nothing in this <br />resolution shall be construed as any assurance that such allocation <br />will be 'available or, if available, will be made. <br /> <br /> 4. Pursuant to the limitations contained in the Temporary <br />Income Tax Regulations Section Sf.103-2(f)(1), this Resolution <br />shall remain in effect for a period of one year from the date of <br />its adoption. <br /> <br /> 5. This Resolution shall take effect immediately upon its <br />adoption. <br /> <br /> Mr. Hendrix stated that Meidinger, Inc. had supplied incorrect <br />figures to the Retirement Benefits Administrator which resulted <br />in over-payment to a small number of retirees~ Mr. Hendrix <br />stated this resolution would authorize the settlement of the claim. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the resolution <br />authorizing settlement of a claim against Meidinger, Inc. was <br />unanimously approved by Council. <br /> <br /> The ordinance entitled "AN ORDINANCE REZONING PROPERTY AT 318 <br /> <br />AND 320 10TH STREET, N.E. FROM R-3 TO B-I," wKiC~ was offered at <br />the December 3rd meeting, was approved by the following vote. Ayes: <br />Mr. Barnes, Mr. Buck, Dr. Gunter, Dr. Hall. Abstaining: Mrs. Gleason. <br />Noes: None. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> ARTICLE II OF CHAPTER 10 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br /> 1976 (AS AMENDED) TO ADD A NEW SECTION NUMBERED 10-9.1 TO PROVIDE <br /> FOR THE ABATEMENT OF REAL PROPERTY ASSESSMENTS ON BUILDINGS WHICH <br /> ARE DAMAGED BY FORTUITOUS HAPPENINGS BEYOND THE CONTROL OF OWNERS, <br /> AND TO MAKE CERTAIN HOUSEKEEPING AMENDMENTS" which was offered at the <br /> meeting of December 3rd, was approved by the following vote. Ayes: <br /> <br /> Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND'AND REORDAIN SECTION <br /> 10'25 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, RELATING TO <br /> EXONERATION OF PENALTIES OR INTEREST ON DELINQUENT TAXES" which was <br /> offered at the meeting of December 3rd, was approved by the following <br /> vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Gunter, Dr. Hall. <br /> Noes: None. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION <br /> 20-16 OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1976), AS AMENDED, <br /> RELATING TO THE INVESTMENT OF CITY RETIREMENT COMMISSION FUNDS" <br /> which was offered at the meeting of December 3rd, was approved by <br /> the following vote.
