Resolution re:
<br />Special Permit for use
<br />of property located
<br />on 15th Street, N. W.
<br />
<br /> WHEREAS, Albe~ma_rle Farmers, Incorporated has applied for
<br />a special permit for its lessee, Isotemp, Inc., to use a portion of
<br />the property owned by it located at 916 Preston Avenue in a B-3
<br />Business District, as an assembly plant, not to exceed 10~000 square
<br />feet in gross floor area with no more than ten percent of such floor
<br />area utilized for fabrication of parts; and
<br />
<br /> WHEREAS, such application has been duly advertised as
<br />provided by law, and has been the subject of a public hearing jointly
<br />held by this Council and the City Planning Commission on April 10
<br />1979; and ,
<br />
<br /> WHEREAS, the City Planning Commission has recommended
<br />approval of such special permit, now, therefore, be it
<br />
<br /> RESOLVED by the Council of the City of Charlottesville,
<br />Virginia, that:
<br />
<br />(1) A portion of the property located in a B-3 Business
<br />District at 916 Preston Avenue, designated as Parcel 57
<br />on City Real Property Tax Map 31, is hereby granted a
<br />special permit for use as an assembly plant, not
<br />exceeding 10,000 square feet in gross floor area, with no
<br />more than ten percent of such floor area to be used
<br />for the fabrication of parts, as permitted under §31-93
<br />of the City Code.
<br />
<br /> (2) The Council finds that such use conforms to the
<br /> requirements for special permits generally imposed by
<br /> Article XX (§31-218 et seq.) of Chapter 31 of the City
<br /> Code,and this permit is subject to all conditions and
<br /> restrictions imposed generally by such article.
<br />
<br /> (3) Such special permit shall be limited to that portion
<br /> of the a~o~esaid property designated for such use
<br /> on the site plan submitted with the special permit
<br /> application, and shall further be conditioned upon
<br /> development of the property in accordance with such site
<br /> plan, as modified by the Planning Commission, and
<br /> finally approved by the Director of Planning.

<br /> A communication was presented from the Planning Commission
<br />recommending that the application for a special permit to use the
<br />property located at Ithe Martha Jefferson House on 15th Street, N. W.
<br />as an infirmary for the nursing home be approved for the following
<br />reasons: 1. it would not be incompatible with theJ1990 Land Use
<br />Plan; and 2. it would not have any adverse impact on the surrounding
<br />neighborhood. On motion by Mr. Gatewood, seconded by Mrs. O'Brien
<br />the following resolution was unanimously adopted.

<br /> WHEREAS, Mrs. Mary Scott Blake has applied for a special
<br />permit to use property located on 15th Street N. W. designated as
<br />Parcel 15 on City Real Property Tax Map 9 as a nursing or convalescent
<br />home; and
<br />
<br /> WHEREAS, a portion of such property is already used for
<br />such purpose by the Martha Jefferson House, as a preexisting non-
<br />conforming use; and
<br />
<br /> WHEREAS, such application has been duly advertised as
<br />provided by law and has been the subject of a public hearing jointly
<br />held by this Council and the City Planning Commission on April 10
<br />1979; and ,
<br />
<br /> WHEREAS, the City Planning Commission has recommended
<br />approval of such special permit, now, therefore, be it
<br />
<br /> RESOLVED by the Council of the City of Charlottesville,
<br />Virginia, that:
<br />
<br />(1) The property located in a R-3 Residential Districn,
<br />on 15th Street, N. W., designated as Parcel 16 on the
<br />City Real Property Tax Map 9, is hereby granted a special
<br />permit for use as a nursing or convalescent home, with-
<br />out limitation as to maximum number of residents, as
<br />permitted un~er §31-28 of the City Code.
<br />
<br />(2) The Council finds that such use conforms to the
<br />requirements for special permits generally imposed by
<br />Article XX (§31-128 et seq.) of Chapter 31 of the City
<br />Code, and thzs permit is subject to all conditions
<br />and restrictions imposed generally by such article.
