Resolution re: <br />Granting a special <br />permit for use of <br />property at 916 <br />Preston Avenue <br /> <br /> WHEREAS, the City Planning Commission has recommended <br />approval of such special permit, now, therefore, be it <br /> RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that: <br /> (1) The property located at the intersection of Smith <br />Street and St. Clair Avenue, designated as Parcel 225 on City <br />Real Property Tax Map 49, is hereby granted a special permit <br />for use as a public utility facility, specifically the expansion <br />of the eXisting sub-station, as permitted under ~31-14 of the City <br />Code. <br /> (2) The Council finds that such use conforms to the <br />requirements for special permits generally imposed by Article <br />XX (§31-218 et seq.) of Chapter 31 of the City Code, and this <br />permit is aubjeCt to all conditions and ~estrictions imposed <br />generally by such. article. <br /> (3) Such special permit shall be conditioned upon <br /> development of the property in accordance with the site plan <br /> submitted with the special permit application, as conditioned <br /> by the Planning Commission and finally approved by the Director <br /> of Planning. <br /> A communication was also presented from the Planning Commission <br /> <br />recommending that the application for a special permit to use <br />the building and property located at the rear of 916 Preston <br />Avenue for storage and light assembly in a B-3 zone be approved <br />for the following reasons: 1. it is in harmony with the Land <br />Use Plan of the Comprehensive Plan; 2. it will not have a <br /> <br />significant adverse impact on the surrounding properties and <br />neighborhood; and 3. it is an appropriate use for this property <br />and adequate measures are being taken to make this use a <br /> <br />compatible one with the surrounding area. <br /> On motion by Mr., Albro, seconded by Mr. Gatewood the following <br /> <br />resolution was unanimously adopted. <br /> <br /> WHEREAS, Albemarle F.armers, Incorporated, has applied <br />for a special permit for its lessee, Isotemp, Inc., to use a <br />portion of the property owned by it located at 916 Preston Avenue <br />in a B-3 Business District, to expand its existing assembly <br />plant, not to exceed 10,000 square feet in gross floor area with <br />no more than ten percent of such floor area utilized for <br />fabrication of parts and for warehouse; and <br /> <br /> WHEREAS, such application has been duly advertised as <br />provided by law, and has been subject of a public hearing held <br />by this Council and the City Planning Commission on January 8, <br />1980; and <br /> <br /> WHEREAS, the City Planning Commission has recommended <br />approval of such ~pecial permit, now, therefore, be it <br /> RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that: <br /> <br /> (1) A portion of the property located in a B-3 Business <br />District at 916 Preston Avenue, designated as Parcel 57 on City <br />Real Property Tax Map 31, is hereby granted a special permit for <br />the expansion of an existing assembly plant, not to exceed <br />10,000 square feet in gross floor area, with no more than ten <br />percent of such floor area to be used for the fabrication of <br />parts, and for warehouses, as permitted under ~31-93 of the City <br />Code. <br /> (2) Th.e Council finds that such use conforms to the <br /> requirements for special permits generally imposed by Article XX <br /> (~31-218 et seq.) of Chapter 31 of the City Code, and t'ais permit <br /> is subject to all conditions and restrictions imposed generally <br /> by such article. <br /> (3) Such special permit shall be limited to that portion <br /> of the aforesaid property designated for such use on the site <br /> plan submitted with the special permit application, and small <br /> further be conditioned upon development of the property in <br /> accordance with such site plan, as conditioned by the Planning <br /> Commission and finally approved by the Director of Planning. <br /> <br /> <br />
