Ordinance re: <br />Vacating right-of-way <br />between Greenbrier <br />& Yorktown Drives <br /> <br />Other business re <br />Letter of congratula- <br />tions to resident <br /> <br />Request for approval <br />re: Funds for Central <br />Dispatch Center <br /> <br />Resolution re: <br />Authorizing condemna- <br />tion proceedings to <br />acquire easement on <br />Parcel 303 on Tax Map <br />4 <br /> <br />353 <br /> <br /> An ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br /> DISCONTINUING A PORTION OF A 20' UTILITY AND/OR PEDESTRIAN <br /> RIGHT-OF-WAY BETWEEN GREENBRIER AND YORKTOWN DRIVES" was presented <br /> to Council. Mr. Wiley stated that he had received a letter from <br /> the attorney of a nearhy owner raising alegal question of whether <br /> title to the right-of-way properly belongs to the original developer <br /> or the nearby present owners, but stated that he thought a title <br /> question of this sort would not preclude the Council's ability to <br /> close the right-of-way. Ms. Gleason expressed concern for the <br /> schoolchildren in the neighborhood who use the path for getting to <br /> school, having no sidewalks in the immediate area to use. Dr. Ivan <br /> K. Crosby of 1900 Greenbrier Drive, one of the peititioners, <br /> explained that they have no interest in preventing the neighborhood <br /> children from using the right-of-way; on the contrary, their concern <br /> is to protect the children in the neighborhood from undesirable <br /> elements who occasionally frequent the right-of-way. Presently, the <br /> adjoining neighbors cannot order these people off the property and <br /> they would simply like to do so by having the right-of-way vacated. <br /> Mr. Wiley expressed the concern that subsequent owners of the <br /> adjacent properties could choose to close or fence off the right- <br /> of-way if it were technically vacated now. Mayor Buck suggested that <br /> the attorney representing the peititioners meet with Mr. Wiley to <br /> work out some solution. With that in mind, on motion by Mr. Albro, <br /> seconded by Ms. Gleason, the ordinance was offered and carried over <br /> to the next meeting for consideration. <br /> <br /> Ms. Gleason brought to the attention of Council that a City <br /> resident, Mr. Davis J. Dunn of 716 Stonehenge Avenue, had reached <br /> his 100th birthday on October 17. She suggested that Council <br /> send a letter of congratulations to him and Council concurred in <br /> this suggestion by common consent. <br /> <br /> Mr. Hendrix requested Council's~ approval for an expenditure <br /> <br />for renovating the firing range of the City police department for <br />use by the central dispatch center. He said that meetings with <br />the University and County had generated this idea as there is <br />no room in the County building for the center, as had originally <br />been hoped. He stated the expense would probably amount to $5,000 <br />to be split three ways between the City, County and University. <br />On motion by Mr. Albro, seconded by Dr~ Hall, Council unanimously <br />approved the request. <br /> <br /> Mr. Wiley requested that Council approve a resolution authorizing <br />condemnation proceedings to acquire an easement across a portion <br />of Parcel 303 on City Real Property Tax Map 4. He said the reason <br />for this action is that all the owners of the property cannot be <br />located. On motion by Mr. Albro, seconded by Dr. Hall, Council <br />unanimously approved the following resolution: <br /> <br /> <br />
