36.8 <br /> <br />Resolution re: <br />Authorizing mayor <br />to sign agreement <br />between City and <br />Southern Railway <br /> <br />Resolution re: <br />Authorizing City Mgr. <br />to apply for state <br />aid for transit <br />administration <br /> <br />unanimously adopted the following resolution: <br /> <br /> WHEREAS the Charlottesville City Council recognizes the existence <br />of a litter problem within the boundaries of the City of Charlottesville <br />and <br /> <br /> WHEREAS the Virginia Litter Control Act of 1976 provides <br />through the Department of Conservation and Economic Development, <br />Division of Litter Control, for the allocation of public funds in the <br />form of grants for the purpose of promoting enforcement of anti- <br />litter statutes and ordinances and for the purpose of enhancing <br />l~cal litter control programs; and <br /> <br /> WHEREAS~having reviewed and considered the regulations and <br />the application concerning administration and use of said funds; <br />now, therefore, be it <br /> <br /> RESOLVED that the Council of the City of Charlottesville, <br />Virginia: <br /> <br /> Hereby endorses and supports such a program for the City of <br />Charlottesville; and <br /> <br /> Hereby expresses the intent to combine with the County of <br />Albemarle in a mutually agreed upon and coordinated program, con- <br />tingent on the approval Of the application by the Department of <br />Conservation and Economic Development, Division of Litter Control, <br />and contingent upon receipt of funds; and <br /> <br /> Hereby authorizes the Charlottesville-Albemarle Clean Community <br />Commission to apply on behalf of all of the above named localities <br />for a grant, and to be responsible for the administration, implementa- <br />tion and completion of the program as it is described in the attached <br />application form LC-GI; and <br /> <br /> Hereby authorizes the Charlottesville-Albemarle Clean Community <br />Commission to plan and budget for a coordinated anti-litter program <br />which shall represent said program for all localities named in this <br />resolution; and <br /> <br /> Further accepts responsibility jointly with the Charlottesville- <br />Albemarle Clean Community Commission and the County of Albemarle fOr <br />alt phases of the program; and <br /> <br /> Further accepts liability for its pro rata share of any funds <br />not properly used or accounted for pursuant to the regulations and <br />the application; and <br /> <br /> That said funds, when received, will be transferred immediately <br />to the Charlottesville-Albemarle Clean Community Commission to be <br />used in said coordinated program which we give our full support and <br />endorsement. <br /> <br /> Hereby request the Repartment of Conservation and Economic <br />Development, Division of Litter Control, to consider and approve the <br />application and program for calendar year 1981-82, said program <br />being in accord with regulations governing use and expenditure of <br />said funds. <br /> <br /> On motion by Mr, Albro, seconded by Mr. Conover, Council unanimously <br />adopted the following resolution: <br /> <br /> BE IT RESOLVED hy the Council of the City of Charlottesville <br />that the Mayor is hereby authorized to execute on behalf of the City <br />the following document, in form approved by the City Attorney: <br /> <br />Agreement between Southern Railway Company and the <br />City of Charlottesville for an easement for an existing <br />eight (8) inch. sewer pipeline located within Southern <br />Railway Company's stone box culvert as shown on print <br />of drawing no. 80-A-112 dated July 10, 1980, and attached <br />to said agreement. <br /> <br /> A copy 'of such document shall be kept on file with the minutes <br />of the Council meeting at which this resoltuion was adopted. <br /> <br />On motion by Dr. Hall, seconded by Mr. Conover, Council <br /> <br />unanimously adopted the following resolution: <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that the City Manager is authorized, for and on behalf of <br />the City, to execute and file an application to the Virginia Dept. <br />of Highways and Transportation, Commonwealth of Virginia, for a <br />grant of transportation special revenues, pursuant to Chapter 760 <br />budget item 640 of the 1980 Acts of the General Assembly (State Aid <br />for Administration) in the amount of $24,900 to defray the public <br />transportation adminstrative expenses of the City of Charlottesville, <br />Virginia, and to accept from the Virginia Department of Highways and <br />Transportation grants in such amount as may be awarded. The City <br />Manager is further authorized and idrected to execute and furnish <br />to the Virginia Departmentoof Highways and Transportation such <br />documents and other information as may be required for processing <br />the grant request; and <br /> <br /> -BE IT FURTHERh.
