28 <br /> <br />Ordinance re: <br />Amendment to Moore's <br />Creek Sewer <br />Moratorium <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION <br />24-1.1 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, RELATING TO <br />THE MORATORIUM ON SANITARY SEWER CONNECTIONS IN THE MOORE'S CREEK <br />DRAINAGE BASIN," which was offered at the meeting of the Council on <br />March 14, 1977, was adoPted by the following recorded vote. Ayes: <br />Mr. Barbour, Mr. Brunton, Mr. Fife, Mr. Gatewood and Mrs. O'Brien. <br /> <br />Ordinance_re: <br />Closing Alley off <br />Goodman Street <br /> <br />Communication re: <br />Planning Commission - <br />Rezoning of property <br />at 434 Fourth St. <br />N. E. - Denied <br /> <br />Noes: None. <br /> <br /> An ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING AN ALLEY OFF OF GOODMAN STREET IN THE CITY OF <br />CHARLOTTESVILLE," which was offered at the meeting of the Council on <br />March 14, 1977, was adopted by ~he following recorded vote. Ayes: <br />Mr. Barbour, Mr. Brunton, Mr. Fife, Mr. Gatewood and Mrs. O'Brien. <br />Noes: None. <br /> <br /> A communication was presented from the Planning Commission <br /> recommending that the petition to rezone property located at <br /> 434 Fourth Street, N. E. from R-3 to B-1 be denied. For the <br /> following reasons: 1. It would be contrary to the 1990 Land Use <br /> Plan; 2. It would be an encroachment of business uses on a <br /> residential neighborhood; and 3. It would effect the traffic <br /> and parking problems in this area. On motion by Mr. Brunton, <br /> seconded by Mr. Fife the recommendations of the Planning Commission <br /> <br />Resolution re: <br />Permitting Albemarle <br />County to do <br />feasibility study <br />on Lane building and <br />requesting that the <br />City be allowed <br />to look at Burley <br />School <br /> <br />was unanimously adopted. <br /> <br /> On motion by Mr. Barbour, seconded by Mr. Gatewood it was ~. <br />unanimously RESOLVED that Albemarle County be permitted to perform <br />a feasibility st~udy study on Lane High School with the intent of <br />making an offer to purchase. The Mayor stated that Council should <br />look at alternative sites for the activities which are presently <br />at Lane in case the County is interested in purchasing the building. <br />On motion by Mr. Fife, seconded by Mr. Barbour it was unanimously <br />RESOLVED that the County be requested to allow the city to take a <br />look at Burley School to see if the building is suitable for the <br /> <br />Resolution re: <br />House~.Bill 1905 <br /> <br />uses presently at Lane. <br /> <br /> On motion by Mr. Brunton, seconded by Mr. Fife the following <br /> <br />resolution was unanimously adopted. <br /> <br /> WHEREAS, the General Assembly of Virginia has adopted <br />House Bill 1905 requiring localities in Virginia to make provision <br />in their local zoning regulations for the establishment of family <br />care homes, foster homes or group homes for mentally retarded or <br />other developmentally disabled persons in residential zoning <br />districts; and <br /> <br /> WHEREAS, this Council has previously made provision in <br />the zoning ordinance of this city for the establishment of such <br />facilities in residential zones under certain conditions; <br /> <br /> NOW, THEREFORE, be it resolved by the Council of the <br />City of Charlottesville endorses the policy embraced in House <br />Bill 1905 as adopted by the General Assembly and urges the <br />Governor to act favorably upon such legislation; and <br /> <br /> BE IT FURTHER RESOLVED that the Clerk of the Council be <br />directed to send a certified copy of this resolution to the <br />Governor. <br /> <br /> <br />
