Consideration re: Ordinance - Rezoning at Bailey Road and 5th Street S. W. DENIED Consideration re: Ordinance - Rezoning at the Corner of llth Street, N.E. and E. Jefferson Streets Work Session set May 8th Work Session set May 22nd Resolution re: UMTA permit for a baseme' for personal use; and 4. Under the present law, the applicant can rent to two unrelated individuals so long as they live together as a single housekeeping unit. On motion by Mr. Fife, seconded by Mr. Brunton the recommendation ~of the Planning Commission was unanimously adopted. A communication was presented from the Planning Commission recommending that the petition to rezone from R-2 to B-2 property located at the northwest and southwest corners of Bailey Road and Fifth Street, S. W. be denied for the following reasons: 1. It is contrary to the 1990 Land Use Plan; 2. It would have an adverse impact .on surrounding newly developed residential area; 3. It would have an adverse imp~act on the natural environment requiring covering of the creek, major grading, and cutting of large trees on one part of the property; 4. There is a neighborhood commercially zoned lane available south of Harris Road in the Willoughby Subdivision zoned PUD and further down facing Fifth Street; and 5. The Planning Commission had designated Fifth Street as a scenic route and its importance as an entrance to the City be maintained. On motion by Mr. Brunton, seconded by Mr. Barbour the foregoing recommendation was unanimously adopted. Mr. Fife requested that the staff give consideration to the improvements which would enhance this entrance to the City. A communication was also presented from the Planning Commission recommending that a petition to rezone from R-2 to B-1 property located at the northeast corner of Ilth Street, N. E. and East Jefferson Street be denied due to the fact that the 1990 Land Use Plan changes and the public hearing forIJthem has not yet been held. The City Attorney advised the Council that it is not necessary to defer action on this rezoning until the 1990 Land Use Plan changes are made. An ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE TO THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 BY THE REZONING OF A PARCEL OF LAND AT THE NORTHEAST CORNER OF llTH STREET, N. E. AND EAST JEFFERSON STREET IN THE CITY OF CHARLOTTESVILLE," was offered by Mr. Fffe, seconded by Mr. Brunnon and carried over to the nexn meeting for consideration. Mr. Fife requested that the Rugby Road area be again cons~.der~d as a bicycle improvement area. A Work session was sen for May 8th to discuss this matter. A work session was set for May 22nd to discuss the formation of an Economic Development Corporation. On motion by Mr. Brunton, seconded by Mr. Fife the following resolution was unanimously adopted. WHEREAS, the City has been advised by the Urban Mass Transportation Administration of the United State Department of Transportation of approval of its application for an amended capital grant under Project No. VA-03-0013, providing for an increase in the number of radio units to fifteen; and
