426 <br /> <br />Resolution re: Authorizing <br />the City Manager to apply <br />for Transit Operating Funds <br /> <br />Ordinance re: Rezoning <br />property on North 1st <br />Street from R-3 to R-2 <br /> <br />Ordinance re: Rezoning <br />property at 507 & 525 <br />Locust Avenue from R-2 to <br />B-1 <br /> <br />Ordinance r~: Rezoning <br />property at the rear of <br />1503 River Road from R-3 <br />to M-1 <br /> <br /> WHEREAS, the identity and whereabouts of all the <br />heirs of Martha Hearns are unknown and there is no way to <br />obtain the easement to the deSired portion of said lot <br />except by condemnation proceedings; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of <br />Charlottesville that the City Attorney be and he is directed <br />to institute condemnation proceedings for the acquisition <br />of the said construction easement to the lot owned by <br />the heirs of Martha Hearns, the identity and whereabouts <br />of all of whom are unknown and to file the necessary <br />documents with the Circuit Court of the City of <br />Charlottesville as provided in ~33.1-89 et seq., ~15.1-898 <br />and ~15.1-899 of the Code of Virginia, 1950, as amended, <br />and §40 and 50.1 of the Charter of the City of Charlottesville. <br /> On motion by Mrs. O'Brien, seconded by Mr. Albro the <br /> following resolution was unanimously adopted. <br /> <br /> BE IT .RESOLVED BY'THE COUNCIL OF THE CITY OF <br /> CHARLOTTESVILLE that the City Manager of the City of <br /> Charlottesville is authorized, for and on behalf of the <br /> City of Charlottesville, to make application to the Virginia <br /> Department of Highways and Transportation, Commonwealth <br /> of Virginia, for a grant of regional transportation <br /> special revenues, budget item 621, paragraph 9, of the <br /> 1978 Acts of the General Assembly - Chapter 850, State <br /> aid for administration, in the amount of $50,000 ($25,000 <br /> for the first year, fiscal year commencing July 1, 1978, <br /> and $25,000 for the second year, fiscal year commencing <br /> July 1, 1979) to defray the administration expenses of the <br /> City of Charlottesville, and to accept from the Virginia <br /> Department of Highways grants in such amount as may be <br /> awarded in accordance with the Virginia Department of Highways <br /> and Transportation Commission resolution dated August <br /> 17~ 1978; and to authorize the City Manager to furnish to <br /> the Virginia Department of~Highways and Transportation such <br /> documents and other information as may be required for <br /> processing the grant application. <br /> The, Council of the City of Charlottesville certifies <br /> that the funds shall be used in accordance with the <br /> requirements of the Appropriation Act of 1978; that the <br /> City of Charlottesville will provide matching funds on a <br /> one to one ratio as required in such Act; that .the record <br /> of receipts and expenditure of funds granted the City of <br /> Charlottesville as authorized in the 1978 Acts of the General <br /> Assembly (Chapter 850) may be subject to audit by the <br /> Department of Highways and Transportation and by the <br /> State Auditor of Public Accounts; and that funds granted to <br /> the City of Charlottesville for defraying the expenses of <br /> Administration of the City of Charlottesville shall be used <br /> only for such purposes as authorized in the Acts of the <br /> General Assembly. <br /> <br /> An ordinance entitled "AN ORDINANCE AMENDING AND <br /> REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 <br /> OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF <br /> CHARLOTTESVILLE, 1976., BY THE REZONING OF PROPERTY ALONG <br /> NORTH FIRST STREET IN THE CITY OF CHARLOTTESVILLE," which was <br /> offered at the meeting of the Council on August 21, 1978, <br /> was adopted by the following recorded vote. Ayes: Mr. <br /> Albro, Mr'. Brunton, Mr. Buck, s-Mr. Gatewood and Mrs. 0'Brien. <br /> <br />No es: None. <br /> <br /> An ordinance entitled "'AN ORDINANCE AMENDING AND <br />REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 <br />OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, BY THE REZONING OF TWO PARCELS <br />LOCATED ON LOCUST AVENUE IN THE CITY OF CHARLOTTESVILLE," <br />which was offered at the meeting of the Council on August <br />21, 1978, was adopted by the following recorded vote.
