Resolution re: Appointing <br />Viewers - Oak Ridge Avenue <br /> <br /> On moti~ Mrs, O'Brien, seconded by Mr. Albro the <br /> <br />following resolution was unanimously adopted. <br /> <br /> A RESOLUTION appointing.viewers to consider a <br />request for the vacation of unopened Oak Ridge Avenue. <br /> <br /> WHEREAS, this Council has received a petition <br />requesting vacation.of unopened Oak Ridge AVenue; and <br /> <br /> WHEREAS, it appears to Council that the notices <br />required ~y §15.1-364 of the Code of Virginia (1950), as <br />amended, aave been duly posted; <br /> <br />Resolution re: Authorizing <br />a special permit for an <br />animal shelter in a B-3 zone <br />on 5th Street, S. W. <br /> <br />Resolution re: Authorizing <br />a special permit for a drive- <br />in restaurant at the N. E. <br />corner of Emmet Street <br />and Morton Drive <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Charlottesville that Messrs. Mason S. Byrd, <br />W. J. Copeland, Sro, and H. P. Winn, Jr., report ~n writing <br />to Council what inconvenience, if any, would result from <br />such vacation. <br /> <br />On motion by Mr. Albro, seconded by Mr. Gatewood the <br /> <br />following resolution was unanimously adopted. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville that there is hereby granted pursuant to <br />§3t-92~of the Code of the City of Charlottesville a <br />special permit for use of the property located at <br />Moore's Creek and 5th Street, S. W. for construction of <br />an animal shelter on such property. Such permit shall <br />be subject to the conditions and regulations set forth <br />in the aforesaid §31-92 as well as to all general <br />conditions and regulations imposed upon special permits <br />by Chapter 31 of such City Code, including the obtaining <br />by the developer of an approved site plan prior to <br />initiating use of the property for such purpose. <br /> <br /> On motion by Mrs. O'Brien, seconded by Mr. Albro <br />the following resolution was unanimously adopted. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville that there is hereby granted pursuant <br />to §31-86 of the Code of the City of Charlottesville a <br />special permit for use of the property located at the <br />northeast corner of Emmet Street and Morton D~ive for <br />construction of a drive-in restaurant facility set forth <br />in the aforesaid §31-86 as well as to all general <br />conditions and regUlations imposed upon special permit <br />by Chapter 31 of such City Code, including the obtaining <br />by the developers of an approved site plan prior to <br />initiating use of the property for such purpose and <br />conditioned further upon the use of mercury vapor <br />lighting rather than sodium vapor, for parking areas on <br />the site.. <br /> <br />Resolution re: Requesting <br />VA. Department of Highways & <br />Transporation to initiate <br />a railroad crossing <br />improvement at 2nd Street, <br />S. E. & C. & 0 R.R. <br /> <br />Mrs. O'Brien requested that Council see the sine plan and <br />Mr. Huja stated that he would be glad to make it available. <br /> <br /> On motion by Mr. Buck, seconded by Mr. Gatewood the <br />following resolution was unanimously adopted. <br /> <br /> WHEREAS, the Council has determined that it is <br />necessary and appropriate for the future transportation <br />safety needs of the City to initiate certain improvements <br />for railroad crossings; and <br /> <br /> WHEREAS, the Virginia Department of Highways <br />and Transportation requires a formal request for each <br />project and certain commitments on the part of the City <br />Council, before the D.epartment can initiate work on <br />such projects; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of <br />Charlottesville: <br /> <br />1. That the Virginia Department of Highways <br />and Transportation be and ~hereby is requested <br />to establish a project within the corporate <br />limits of the City of Charlottesville for the <br />installation of crossing gates at the Chesapeake <br />and Ohio Railroad and Second Street southeast. <br /> <br />2. That the City hereby agrees to pay its share <br />of the cost of engineering, acquisition of <br />right-of-way, and construction of such project <br />under the cost formula of 90% from the Department <br />and 10% from the City. <br /> <br />44.3 <br /> <br /> <br />
