Resolution re: Appointing Viewers - Oak Ridge Avenue On moti~ Mrs, O'Brien, seconded by Mr. Albro the following resolution was unanimously adopted. A RESOLUTION appointing.viewers to consider a request for the vacation of unopened Oak Ridge Avenue. WHEREAS, this Council has received a petition requesting vacation.of unopened Oak Ridge AVenue; and WHEREAS, it appears to Council that the notices required ~y §15.1-364 of the Code of Virginia (1950), as amended, aave been duly posted; Resolution re: Authorizing a special permit for an animal shelter in a B-3 zone on 5th Street, S. W. Resolution re: Authorizing a special permit for a drive- in restaurant at the N. E. corner of Emmet Street and Morton Drive NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Charlottesville that Messrs. Mason S. Byrd, W. J. Copeland, Sro, and H. P. Winn, Jr., report ~n writing to Council what inconvenience, if any, would result from such vacation. On motion by Mr. Albro, seconded by Mr. Gatewood the following resolution was unanimously adopted. BE IT RESOLVED by the Council of the City of Charlottesville that there is hereby granted pursuant to §3t-92~of the Code of the City of Charlottesville a special permit for use of the property located at Moore's Creek and 5th Street, S. W. for construction of an animal shelter on such property. Such permit shall be subject to the conditions and regulations set forth in the aforesaid §31-92 as well as to all general conditions and regulations imposed upon special permits by Chapter 31 of such City Code, including the obtaining by the developer of an approved site plan prior to initiating use of the property for such purpose. On motion by Mrs. O'Brien, seconded by Mr. Albro the following resolution was unanimously adopted. BE IT RESOLVED by the Council of the City of Charlottesville that there is hereby granted pursuant to §31-86 of the Code of the City of Charlottesville a special permit for use of the property located at the northeast corner of Emmet Street and Morton D~ive for construction of a drive-in restaurant facility set forth in the aforesaid §31-86 as well as to all general conditions and regUlations imposed upon special permit by Chapter 31 of such City Code, including the obtaining by the developers of an approved site plan prior to initiating use of the property for such purpose and conditioned further upon the use of mercury vapor lighting rather than sodium vapor, for parking areas on the site.. Resolution re: Requesting VA. Department of Highways & Transporation to initiate a railroad crossing improvement at 2nd Street, S. E. & C. & 0 R.R. Mrs. O'Brien requested that Council see the sine plan and Mr. Huja stated that he would be glad to make it available. On motion by Mr. Buck, seconded by Mr. Gatewood the following resolution was unanimously adopted. WHEREAS, the Council has determined that it is necessary and appropriate for the future transportation safety needs of the City to initiate certain improvements for railroad crossings; and WHEREAS, the Virginia Department of Highways and Transportation requires a formal request for each project and certain commitments on the part of the City Council, before the D.epartment can initiate work on such projects; now, therefore, be it RESOLVED by the Council of the City of Charlottesville: 1. That the Virginia Department of Highways and Transportation be and ~hereby is requested to establish a project within the corporate limits of the City of Charlottesville for the installation of crossing gates at the Chesapeake and Ohio Railroad and Second Street southeast. 2. That the City hereby agrees to pay its share of the cost of engineering, acquisition of right-of-way, and construction of such project under the cost formula of 90% from the Department and 10% from the City. 44.3
