z 80 <br /> <br />1. A special permit is hereby granted pursuant to <br />~31-33 of the City Code, for development of such <br />property at a maximum residential density of 91 <br />"~ni~s~, Or 87 units per acre. The Council finds and <br />declares that the proposed project is in substantial <br />compliance with the standards and requirements for <br />such residential higher density special permits set <br />forth:~ in ~3I~33, and this permit is hereby expressly <br />conditi°n~d upon development of the property in <br />conformitY with such standards and conditions. <br /> <br />2. A further special permit is hereby granted pursuant <br />to ~31'-140. 1 of the City Code for the proposed building <br />to be constructed on such property to a maximum height <br />of seventy'five feet from grade to cornice line. The <br />Council hereby finds and declares that the height <br />of such' proposed building is appropriate to such <br />lo'ca'tion~' d~es not have undue ~dverse impact on the <br />scale and architectural harmony of the Architectural <br />Design Control Design District,. and permits adequate <br />sunlight and open air on the adjacent streets. The <br />Council further' finds that the proposed location and <br />design of such building and the procedures by which <br />it has been conSidered substantially conform to <br />t~ other requirements of such ~31-140.1, and the <br />granting of this permit is hereby expressly conditioned <br />upon construction of the project in substantial <br />conformity therewith. <br /> <br />3. Pursuant to §31-228.1 of the City Code, modifications <br />are heceby granted to the required front and rear <br />yard normally applicable in B-1 Business Districts. As <br />applied to the subject property such modifictions shall <br />be a reduction of fifteen feet in the customary setback <br />for the front yard (High Street side) and a reduction <br />of twenty feet in the customary setback for the rear <br />yard (Jefferson Street side). The Council finds and <br />declares. that such modifications are in harmony with <br />the purposes and intents of Article IV, IX, XVI, and <br />XX of Chapter 31 of the.~City Code, under which the <br />foregoing special permits and modifications, are being <br />sought, .an, d further finds and declares that such <br />modificatl°ns are necessary and desirable in view <br />of the nature, circumstances, location and situation <br />of the projec~t proposed for such property. Such <br />modifications are hereby imposed as specific conditions <br />of the foregoing special permits, and the project <br />shall be develoPed in full conformity therewith. <br /> <br />4. The Council further finds and declares that the <br />application for the aforesaid special permits <br />substantially Conforms to the standards, conditions <br />and procedures established for special permits <br />generallY-by Article XX (Sec. 31-218 et seq.) of <br />Chapter. 3'1 of the City Code. The granting of such <br />special permits and modifications is hereby conditioned <br />upon execution of the proposed project in full compliance <br />with such article, as well as with all other applicable <br />.city ordinances and state or federal law. <br /> <br />5. The following special conditions shall also be <br />applicable to. the granting of such special permits <br />and modifications. <br /> <br />(a) The prop.erty shall be developed in substantial <br />conformity with the basic site plan as preliminary <br />approved by the Planning Commission on January 9, <br />1979'. .The Commission shall be responsible for final <br />review and approval of such site plan following <br />submission by the applicant of detailed plans for: <br /> <br /> (i) Final landscaping details of the courtyard <br /> or plaza area and other exterior open spaces; <br /> (ii) location, character, size, height and <br /> orientation of proposed signs; and <br />(iii) location, nature, intensity and directional <br /> characteristics of all exterior lighting fixtures. <br /> <br />(b) The applicant shall submit for approval by the <br />Director of Planning, locations, dimensions and <br />descriptions of recreational spaces and amenities <br />required under City Code ~31-34. <br /> <br />(c) The applicant shall correct or eliminate four <br />under.sized parking spaces at the northwest corner <br />of each level of underground parking areas in the <br />proposed building. <br /> <br /> <br />
