Resolutinn re: Asking <br />that the Southern and <br />Chesapeake and Ohio <br />Railways not be stopped <br />from coming thru <br />Charlottesville <br /> <br />Resolution re: Authorizing <br />the Mayor to sign deed <br />of easement <br /> <br />Executive session <br /> <br />495 <br /> <br /> .' ~gS~ Senate Bill 623, pending in the General <br />Assembly of ~Vir~i~ia, would impose upon the legal department <br />of local governments the duty of conducting right-of-way <br />acquisition and condemnation li-igation for the Virginia <br />Department of Highways and Transportation; and <br /> <br /> WHEREAS, ~his legislation provides inadequate <br />assurance that the localities would be fully reimbursed <br />for their true costs in providing this service; and <br /> <br /> WHEREAS, this legislation presents the potential <br />for practical and ethical conflicts of interest for the <br />local government attorneys upon whom this responsibility <br />would be imposed; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of <br />Charlottesville that Senate Bill 623 is not deemed by this <br />Council to serve the best interest of the Commonwealth <br />or its local governments; and be it further <br /> <br /> RESOLVED that the Governor is respectfully requested <br />to exercise his executive discretion-~to veto this unwise <br />legislation. <br /> <br />On motion by Mr. Albro, seconded by Mrs. O'Brien the <br /> <br />following resolution was unanimously adopted. <br /> <br /> WHEREAS, Charlottesville has historically benefited <br />from the availability of passenger rail transportation along <br />the routes of the Southern and Chesapeake and Ohio Railways- <br />and , <br /> <br /> WHEREAS, continued passenger rail service along <br />such routes has major economic and social benefits to the <br />Charlottesville community; and <br /> <br /> WHEREAS, the maintenance of a strong nationwide <br />passenger rail network is an essential component of a <br />balanced national transportation system, providing a <br />safe, energy-efficient, weather-proof alternative to other <br />transportation modes; and <br /> <br /> WHEREAS, the Secrenary of Transportation has <br />announced that he proposes, to order the discontinuance of <br />AMTRAK rail passenger service on both routes currently <br />providing service to Charlottesville; now therefore <br />be it ' ' <br /> <br /> RESOLVED hy the Council of the City of <br />Charlottesville, Virginia, that the Congress of the United <br />States ~s respectfully requested to act to Qverrule the <br />aforesaid proposal of the Secretary of Transportation, <br />within the time period provided by law; and be it further <br /> <br /> RESOLVED that the Secretary of Transportation, <br />the members of Congress representing Charlottesville, <br />and the Virginia Department of Highways and Transportation <br />are urged to take all appropriate actions to preserve all <br />existing rail passenger service to Charlottesville and <br />the Central Virginia area. <br /> <br /> On motion by Mr. Albro, seconded by Mr. Gatewood the <br />following resolution was adopted by the following recorded <br />vote. Ayes: Mr. Albro, Mr. Brunton, Mr. Gatewood and <br />Mrs. O'Brien. Noes: None. Abstained: Mr. Buck. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, that the Mayor is hereby authorized to <br />execute on behalf of the City the following document, in <br />form approved by the City Attorney: <br /> <br /> A Deed of Easement to George H. Gilliam, Trustee <br />for Walker Land Trust for a 20' wide utility easement <br />for a dry hydrant across property belonging to the City near <br />the Rivanna River Reservior. <br /> <br /> A copy of such document shall be kept.on file <br />with the minutes of the Council meeting at whic~ this <br />resolution was adopted. <br /> <br /> A motion by Mrs. O'Brien, seconded by Mr. Buck that <br />Council meet in exeo~tive session to discuss a matter <br /> <br /> <br />
