PUBLIC HEARING RE: <br />REZONING JOHNSON <br />VILLAGE <br /> <br />REZONING PETITION <br />DENIED <br /> <br /> A PUBLIC HEARING WAS HELD ON THIS DATE ON A PETITION TO REZONE JOHNSON VILLAGE <br />SUBDIVISION FROM R-2 TO R-1 or TO CREATE A NEW ZONING CLASSIFICATION WITH THE SAME <br />HEIGHT AND AREA REGULATIONS AS PRESENT R-2~ BUT RESTRICTED TO USES PERMITTED UNDER <br />THE PRESENT R-1. <br /> <br />Mr. JACK HORN~ CHAIRMAN OF THE PLANNING COMMISSION, OUTLINED THE HISTORY OF THE <br />PETITION AND THE RECOMHENDATION OF THE PLANNING COMMISSION. THE CITY ATTORNEY ADVISED <br /> <br />THE COUNCIL THAT REZONING TO R-1 COULD EXPOSE THE PROPERTY OWNERS TO POSSIBLE HARDSHIP <br /> <br />BY THE' CREATION OF NON-CONFORMING USES AND THAT THE COUNCIL COULD NOT GRANT A <br /> <br />BLANKET VARIANCE. MR, STEVE HELVIN, ATTORNEY FOR THE PROPERTY OWNERS, HR.JIM HARDELL <br /> <br />AND MR. JEFFREY MORTON ADDRESSED THE COUNCIL 1N FAVOR Of THE PETITION. MR. GEORGE <br /> <br />GILLIAM~ ATTORNEY FOR LEROY BRUTON, AND SEVERAL PROPERTY OWNERS ADDRESSED THE COUNCIL <br /> <br />IN OPPOSITION. A MOTION BY MR. BARBOUR~ MR. DAVIS~ MR. FIFE ~ND MR. VAN YAHRES. ABSENT: Mr. WRIGHT. <br /> REv. BENJAMINF. BUNN~ PASTOR FIRST BAPTIST CHURCH, GAVE THE INVOCATION. <br /> <br /> THE MINUTES OF THE MEETINGS OF OCTOBER 19, 1970 AND OCTOBER 20~ 1970WERE READ <br /> <br />AND APPROVED. <br /> <br /> A COMMUNICATION WAS PRESENTED FROM.iG. H, STORY, JR. REQUESTING THAT SERIOUS <br />CONSIDERATION BE GIVEN TO TAKING THE NECESSARY STEPS TO FULLY UTILIZE WEST HAIN STREET <br />FOR THE FLOW OF TRAFFIC. THE CITY MANAGER ADVISED THE COUNCIL THAT THE TRAFFIC LIGHTS <br />ARE SYNCHRONIZED TO THE BEST POSSIBLE ADVANTAGE AND THE STREET IS BEING UTILIZED TO <br />THE BEST POSSIBLE ADVANTAGE UNLESS ALL PARKING IS REMOVED. ON MOTION BY MR. FIFE~ <br />SECONDED BY MR. DAVlS~ THiS MATTER WAS REFERRED TO THE STREET COMMITTEE TO CONFER <br /> <br />WITH UNIVERSITY OFFICIALS ON AN APPROACH TO A STUDY OF THE TRAFFIC AND PARKING PROBLEMS <br /> <br />~N THE AREA. <br /> <br /> A COMMITTEE REPORT WAS PRESENTED RECOMMENDING THAT THE REQUEST FOR ONE WATER METER <br /> <br />TO SERVE OAK RIDGE GARDENS BE DENIED. ON MOTION BY MR. DAVIS) SECONDED BY MR. BARBOUR~ <br /> <br />THE FOREGOING RECOMMENDATION WAS UNANIMOUSLY ADOPTED. <br /> <br /> THE CITY MANAGER PRESENTED HIS PROPOSED FIVE YEAR CAPITAL IMPROVEMENTS BUDGET tN <br /> <br />THE AMOUNT OF ~25,900,000.00. ON MOTION BY MR. DAVIS, SECONDED BY MR. FIFE~ THE <br />CAPITAL IMPROVEMENTS BUDGET WAS UNANIMOUSLY APPROVED. <br /> <br /> AN ORDINANCE ENTITLED "AN ORDINANCE AMENDING AND REENACTING SECTION 18-187 OF THE <br /> <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1965~ TO PROVIDE ADDITIONAL MEMBERS TO SERVE ON <br /> <br />THE H1GH~¢~AY SAFETY COMMISSION" WAS OFFERED BY MR. BARBOUR, SECONDED BY MR. FIRE~ AND <br />CARRIED OVER TO THE NEXT MEETING FOR CONSIDERATION. <br /> <br /> THE RESOLUTION APPROPRIATING $17,945.00 FOR GAS LINE TO SERVE "FOUR SEASONS~, <br />WHICH WAS OFFERED AT THE MEETING OF THE COUNCIL ON OCTOBER 19~ 1970, WAS ADOPTED BY <br /> <br />THE FOLLOWING RECORDED VOTE: AYES: MR. BARBOUR, MR. DAVIS, MR. FIFE AND MR. VAN YAHRESo <br />NOES: NONE. <br /> <br /> A COMMUNICATION WAS PRESENTED FROM DOWNTOWN CHARLOTTESVILLE~ INC. REQUESTING <br />PERMISSION TO USE TWO PARKING SPACES AT 3RD AND E. MAIN STREETS FOR A CHRISTMAS COTTAGE <br />FROM NOVEMBER ~SRD TO DECEMBER 27TH, 1970. ON MOTION BY MR.
