9 <br /> <br /> <br />APPROPRIATION <br />f. : $20,000 - Reappropriating OAR Funds for Drug Court <br />nd <br /> (2 reading) <br /> <br /> BE IT RESOLVED <br />by the Council of the City of Charlottesville, Virginia, that <br />the sum of $182,500.00, to be received as a grant from the Virginia Department of <br />Criminal Justice Services, is hereby appropriated to account 11 - 230 - 032045 in the Grants <br />Fund for the purpose of operating the Charlottesville - Albemarle Drug Treatment Court in <br />Fiscal Year 2003. The Memorandum o f Agreement (MOA) between the City of <br />Charlottesville and the Virginia Department of Criminal Justice Services sets forth the <br />allocation of funds, which are substantially as follows: <br /> <br />Offender Aid & Restoration/Jefferson Area Community Correction $ 92,30 6 <br />Region Ten Community Services Board $ 58,996 <br />City of Charlottesville $ 31,198 <br /> <br /> Total $182,500 <br /> <br />nd <br />APPROPRIATION <br />g. : $582,684 - Reallocation of Schools Fund Balance (2 reading) <br /> <br />WHEREAS, <br /> to ensure the maintenance of school facilities an d provide an <br />environment for students that is conducive for learning; now, therefore, <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia, that <br />the sum of $582,684.00, received from the City School System, is hereby appropriated <br />into ac count 24 - 181 - 081119 - 53199 for use by the Facilities Management Division of the <br />Public Works Department for Charlottesville City Schools capital projects. <br /> <br />APPROPRIATION <br />h. : $5,500 - Grant for Restorative Justice Program (carried over) <br /> <br />APPROPRIATION <br />i. : $182,5 00 - Drug Court Grant (carried over) <br /> <br />th <br />RESOLUTION <br />j. : Approving Special Permit for Daycare Center at 415 10 <br /> Street, N.W. <br /> <br />WHEREAS <br />, pursuant to the Code of the City of Charlottesville, section 34 - <br /> <br />th <br />139(5), Ivy Square Realty, the owner of the property located at 415 10 St., N.W., on <br />behalf of New Covenant Pentecostal Church, has requested a special permit to allow a <br />child day care facility for up to ten (10) children, the property subject to the application <br />bei ng further identified on 2002 City Tax Map 4 as Parcel 46 (approximately 7,875 <br />square feet of land; or 0.18 acre). The property subject to the application has <br />th <br />approximately, 75 feet of frontage on 10 Street, N.W., and approximately 105 feet of <br />frontage along Grady Avenue; <br /> <br />WHEREAS <br /> , a joint public hearing on this application was held before the City <br />Council and Planning Commission on July 9, 2002, following notice to the public and to <br />adjacent property owners as required by law; and <br /> <br />WHEREAS <br />, this Counci l finds and determines that such use will conform to the <br />criteria applicable to special permits generally under Chapter 34 of the City Code; now, <br />therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit i s hereby approved and granted, to allow the following use at the <br />property which is the subject of this application: a child day - care facility. This special <br />use permit is conditioned upon the following: <br /> <br />1. A minimum of two (2) off - street parking spaces for u se by staff of the day care <br />facility must be provided at all times, either on - site or off - site by agreement with <br />another property owner. <br />
