8 <br /> Mr. Brown said that historically cities requir e franchise fees for the right to put <br />telephone and utility lines in public rights - of - way. In 1998 the Telecommunications Act <br />altered that practice and enacted PROW fee provisions. Mr. Brown said that if Council is <br />inclined to consider a fee, an ordinanc e can be drafted and placed on a future agenda. <br />Mr. Brown said the fee would be collected by VDOT, but passed on to customers. <br /> <br /> Mr. Schilling said he sees PROW as a regressive tax, and noted that corporations <br />do not pay the tax, they pass it along. <br /> <br /> Ms. Richards said she has no strong feelings about the fee and feels it is hard to <br />understand the impacts. <br /> <br /> There was no consensus on Council to move ahead with drafting an ordinance. <br /> <br />ORDINANCE <br />: APPROVING FRANCHISE AGREEMENT FOR NTELOS <br /> <br /> Mr. Brown said tha t the franchise agreement will be for five years and is identical <br />to previous franchise agreements approved by Council. <br /> <br /> Mr. Schilling asked what happens if a company has financial difficulties, and Mr. <br />Brown replied that the lines are already in place fo r the most part, but the City would <br />have to monitor the situation. <br /> <br />On motion by Mr. Caravati, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE GRANTING A TELECOMMUNICATIONS FRANCHISE TO <br />NTELOS, INC., ITS SUCCESSORS AND ASSIGNS TO USE THE STREET S AND <br />OTHER PUBLIC PLACES OF THE CITY OF CHARLOTTESVILLE, VIRGINIA FOR <br />ITS POLES, WIRES, CONDUITS, CABLES AND FIXTURES FOR A PERIOD OF <br />FIVE (5 YEARS)" was offered and carried over to the next meeting for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: LEASE OF IVY CREEK NATURAL AREA <br />TENANT HOUSE <br /> <br /> Mr. Brown said that a public hearing is required prior to approving the following <br />two leases. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Mr. Schilling asked for inf ormation about how these lease amounts compare to <br />the rental market. <br /> <br />On motion by Mr. Caravati, seconded by Mr. Schilling, the ordinance entitled <br />"AN ORDINANCE APPROVING LEASE AGREEMENT FOR IVY CREEK <br />NATURAL AREA TENANT HOUSE" was offered and carried over to the next meeting <br />for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: RENEWING LEASE OF RAGGED <br />MOUNTAIN TENANT HOUSE <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br />On motion by Mr. Caravati, seconded by Mr. L ynch the ordinance entitled "AN <br />ORDINANCE APPROVING AMENDMENT TO LEASE AGREEMENT FOR <br />RAGGED MOUNTAIN RESERVOIR TENANT HOUSE" was offered and carried over <br />to the next meeting for consideration. <br /> <br />CONSENT AGENDA <br /> <br />
