8 <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia, that <br />the sum of $209,586.97 from the Belmont Loft Company, LLC be appropriated from <br />account 26 - 020 - 051659 - 44227 in the Capital Fund to account 26 - 020 - 051528 - 50111 in <br />the Capital Fund. <br /> <br />APPROPRIATION <br /> e. : Year End Adjustments (carried over) <br /> <br />APPROPRIATION <br /> f. : $275,000 - Weed and Seed Program Grant <br /> (carried over) <br /> <br />APPROPRIATION <br /> g. : $62,257.14 - Records Conversion Grant for Clerk <br /> of Circuit Court (carried over) <br /> <br />RESOLUTION <br /> h. : Amending Special Use Permit to Enlarge <br /> Amusement Arcad e for Charlottesville Ice Park <br /> <br />WHEREAS <br />, the owner of the Charlottesville Ice Park located at 230 West Main <br />Street has requested an amendment to the special use permit granted by City Council on <br />June 16, 1997, seeking to allow an amusement arcade within th e Ice Park to be enlarged <br />from 1,000 square feet to 1,500 square feet and relocated to the Water Street Terrace <br />portion of the building; and <br /> <br />WHEREAS <br />, the properties which are the subject of this application may be <br />further identified as Parcel 1 and a port ion of Parcel 9.1 on 2002 City Real Property Tax <br />Map 28, having, collectively, approximately 336 feet of frontage on the Downtown Mall, <br />154 feet of frontage on Water Street, and containing approximately 40,794 square feet of <br />land or .94 acres; and <br /> <br />WHEREAS <br />, a joint public hearing on this application was held before the City <br />Council and Planning Commission on November 19, 2002, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br />WHEREAS, <br /> this Council finds that such use w ill conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that <br />the special use permit granted by City Council on June 16, 19 97, is hereby amended to <br />allow enlargement of the amusement arcade within the Ice Park from 1,000 square feet to <br />1,500 square feet and relocation of the arcade to the Water Street Terrace portion of the <br />Charlottesville Ice Park. This amended special use pe rmit is conditioned upon the <br />following: <br /> <br />6. The amusement arcade shall be located in the area shown on the approved plan, <br />consisting of approximately 1,500 square feet of floor area at the terrace level of <br />230 West Main Street and accessed through the Ice Par k lobby only. <br />7. The hours of operation shall be limited to the hours of operation for the Ice Park; <br />however the amusement arcade shall not operate any later than midnight. <br />8. At all times during operation of the amusement arcade, a manager and a minimum <br />of one employee shall be on duty at the Ice Park to monitor use of the arcade. <br />9. The amusement arcade shall not be used for gaming or other activities requiring <br />special state license (such as lotto or off - track betting). <br />10. The number of people permitted by the Buildi ng code to occupy the amusement <br />arcade space shall be posted in the facility. <br />11. The Water Street exit door from the Ice Park shall be for emergency use only. <br />12.
