He said the rezoning will lead to <br />the degradation of the quality of life in the neighborhood. <br /> <br /> Ms. Michele Mattioli, 1404 E. Market Stre et, requested that Council deny the <br />rezoning. She said she hopes the applicant can find an appropriate location for his <br />business. Ms. Mattioli said rezoning changes the future use regardless of the owners of <br />the business. She said that the applicant doe s not even own the property. She said <br />houses have been renovated on that street and the street is very narrow. She expressed <br />concern about the large parking lot proposed and the footprint of the building, and about <br />the sound generated by sheet metal fabr ication. <br /> <br /> Ms. Pat Deane, 1413 Burgess Lane, said she has lived on Burgess Lane for 23 <br />years and it is a nice quiet place. She said this business will totally change the street and <br />will pose a danger to kids. <br /> <br /> Mr. Steve Holsapple, 1611 Cherry Avenue, a small business owner, said there are <br />no places for small businesses to go in the City. He said he has researched this area and <br />said it is surrounded by a junk yard and scrap yard. He said the lot is already approved <br />for four duplexes which would generate a lot of traffic. He said the industrial use will <br />increase values in the neighborhood. Mr. Holsapple said the applicant will work with the <br />City on the appearance of the building and landscaping. <br /> <br /> Ms. Rosemary Johnson, 1407 Burgess Lane, said she has a lovely house and yard, <br />but there are a lot of mosquitoes from businesses in the neighborhood and she is opposed <br />to the rezoning. <br /> <br /> Mr. Preston Syme, 1600 E. Market Street, opposed the rezoning and said it is not <br />a reasonable use for this property. <br /> <br /> Mr. Kerry Goodman, 1401 Burgess Lane, said the rezoning will result in <br />increased traffic and will make the street less safe for children. <br /> <br />nd <br /> Mr. Preston Coiner, 411 2 Street, N.E., owner of the recycling business on <br />Market Street, clarified that Burgess Lane is not used to access his building. He also said <br />that there is a city wide problem with mosquitoes and the problem is not unique to <br />Burgess Lane. <br /> <br /> Mr. Lewis Schultz, 1809 E. Market Street, said that if this rezoning is approved, <br />businesses will continue to encroach on Market Street. <br /> <br /> Ms. Laura Covert, 1809 E. Market Street, opposed the rezoning. She said it is a <br />very narrow street and the area already bears the burden of industrial and businesses. <br /> <br /> As there were no further speakers, the public hearing w as closed. <br /> <br /> Mr. Joe Kerley, applicant of the rezoning, read a letter from the former resident of <br />the property saying that it is unsuitable for residences and that she always thought the <br />property was commercial. Mr. Kerley pointed out that staff recommend ed that the <br />property be rezoned to B - 3 which would allow his use. He said he has worked with the <br />City to try to find another location to expand his business, but has had no success. Mr. <br />Kerley said he wants to remain in the City. He said his business wil l not generate noise <br />and he will not fabricate metal on the site. Mr. Kerley said a significant portion of the <br />building is proposed to be under ground. <br /> <br /> Responding to a request from Mr. Caravati, Mr. Tolbert reviewed uses that would <br />be allowed in B - 3. H e noted that no request had been submitted for duplexes on the site, <br />but said they would be allowed under the current zoning. <br /> <br /> Ms. Richards said she admires Mr. Kerley for his persistence, courage, and desire <br />to expand his business. She said that while s he is sensitive to that, she hears the universal <br />desire from the neighborhood not to have additional industrial use in the neighborhood. <br />
