The local <br />match of $7,188 is hereby appropriated from General Fund acc ount 05 - 301 - 131030 and <br />transferred to account 11 - 230 - 041153 in the Grants Fund. This appropriation is <br />conditioned upon receipt of $38,238 from the Virginia Department of Criminal Justice <br />Services. <br /> <br />APPROPRIATION <br /> e. : $1,750 - Parks Refund from Insurance Proceeds <br /> (carried over) <br /> <br />APPROPRIATION <br /> f. : Community Development Block Grant and Housing <br /> Opportunities Made Equal Grant for FY 03/04 <br /> (carried over) <br /> <br />APPROPRIATION <br /> g. : $289,724 - School Funds for CHS Boiler <br /> (carried over) <br /> <br />RESOLUTION <br /> h. : Amendment to Adelphia Default Resolution <br /> <br />WHEREAS <br />, on or about May 28, 1992, the City of Charlottesville, Virginia <br /> <br />(“City”) granted a Cable Television Franchise Ordinance (“Franchise”) to Multi - Channel <br /> <br />Cable TV Company (“MCCTV”); and <br />WHEREA S <br /> , MCCTV’s rights under the City’s Franchise were transferred and <br />assigned to Adelphia Communications (“Adelphia”), and City consented to and approved <br />of said transfer and assignment; and <br />WHEREAS <br /> , Section 10.01(A) of the Franchise provides that Adelphia shall pay <br />to the City a Franchise Fee equal to five percent of its gross revenues; and <br />WHEREAS <br /> , Section 10.01(E) of the Franchise provides that in the event any <br />payment is not made on the due date, simple interest on the amount due shall accrue from <br />such date at the annual rate of twelve percent; <br />WHEREAS <br />, pursuant to Adelphia’s written request of January 10, 2003, the City <br />Council deferred action on this Resolution based upon Adelphia’s agreement to provide <br />Lewis and Associates certain information relatin g to Adelphia’s advertising revenues <br />(“Requested Information”); and <br />WHEREAS <br />, on April 21, 2003, at a regularly scheduled City Council meeting, <br />the City Council was provided information from the City staff concerning Adelphia’s <br />
