She said a <br />serious discussion needs to be held with the City Attorney and police about the Act. <br /> <br /> Mr. Cox asked Mr. Brown for his opinion about the wording of th e paragraph <br />referred to by Ms. Richards, and Mr. Brown said he would need to review it before <br />offering an opinion. <br /> <br /> Mr. Lynch proposed amendments striking the first paragraph and reordering the <br />paragraphs, and Ms. Richards accepted the amendments. <br /> <br /> Mr. Lynch proposed adding a new paragraph six, and Ms. Richards accepted the <br />amendment. <br /> <br /> Mr. Lynch proposed striking the last half of paragraph eleven and adding <br />language which gets at the issue of City employees taking stronger action. He said he <br />does not f eel it is good policy to put City employees in a position of having to break a <br />law and putting them in jeopardy. Ms. Richards accepted the amendment. <br /> <br /> Mr. Lynch said we may want to affirm the sunsetting of the Patriot Act and made <br />a motion to amend the r esolution to that effect. <br /> <br /> Ms. Richards said that would be fine but we are already asking that it be repealed <br />which is something more immediate. Ms. Richards said that to the extent that we would <br />wish to instruct public safety, schools and library empl oyees not to participate with the <br />Patriot Act, we would have to indemnify the City, not individuals, and said this is <br />something that needs to be addressed. <br /> <br /> Mr. Lynch made a motion to add a paragraph from the republican resolution <br />which sets up the expect ation to use due process. <br /> <br /> Mr. Brown said he thinks that language would be appropriate. <br /> <br /> Ms. Richards accepted the amendment and suggested that it be inserted in lieu of <br />paragraph ten. Mr. Lynch agreed. <br /> <br /> Mr. Brown reviewed the amendments made to the re solution. <br /> <br /> Mr. Schilling said his proposed action does not reflect his personal opinion of the <br />Patriot Act. He thanked speakers for their comments. He said that in reviewing the <br />resolution it appears that Council is over stepping its charter. He said C ouncil bears no <br />direct responsibility for this. He said it is the responsibility for all citizens to speak out <br />and encouraged them to directly contact their federal representatives. He regretted the <br />time spent by staff and Council on this issue which is causing other issues to be delayed. <br /> <br /> Mr. Lynch said he thinks Council taking action on the resolution is an entirely <br />appropriate issue to take up.
