PUBLIC HEARING/ORDINANCE : CONTINUING CURRENT WATER RATES Mr. O'Connell said that the utility rates approved in June, 2003 had a sunset clause. He sa id no decision was made by Council at their November work session on an alternative water rate structure. He said the proposal is to bring back the issue back to Council in February and to extend the current rates. The public hearing was opened but as t here were no speakers, the public hearing was closed. Mr. Lynch said he would like to tie the water rates to the level of the reservoir and asked if staff has discussed this with Albemarle County. Ms. Rita Scott, Director of Finance, said she would like to have this discussion. On motion by Mr. Schilling, seconded by Mr. Lynch, the ordinance entitled "AN ORDINANCE REORDAINING CHAPTER 31 (UTILITIES) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO UTILITY RATES ADOPTED JUNE 16 , 2003" was offered and carried over to the next meeting for consideration. PUBLIC HEARING/RESOLUTION : WATER COST ALLOCATION STUDY AND CREST CONTROL PROJECT Ms. Judith Mueller, Director of Public Works, explained that the proposed agreement allocates the existing treatment capacity (48% City, 52% Albemarle County Service Authority); the water supply in the urban system (65% City/35% ACSA); and the new supply to be created at the South Fork Rivanna Reservoir (27% City; 73% ACSA). She that that in addit ion, ACSA agrees to pay for the 5 mgd plant expansion at the South Rivanna facilities that occurred in 1999 and will repay the City for the debt service it has paid on the expansion. The public hearing was opened but as there were no speakers, the public hearing was closed. On motion by Mr. Lynch, seconded by Mr. Caravati, Council approve the Water Cost Allocation Agreement by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. BE IT RESOLVED by the Council for the City of Charlottesville, Virginia that the Mayor is authorized to execute on behalf of the City the attached agreement between the City of Charlottesville, the Albemarle County Service Authority and the Rivanna Water and Sewer Authority, pr oviding for an allocation of the existing and future urban water supply, and costs related thereto. BE IT FURTHER RESOLVED that upon the execution of the attached agreement by all parties, the Rivanna Water and Sewer Authority is requested to proceed wit h the planning, design and construction of a crest control project at the South Rivanna Reservoir, in order to increase the area’s supply of potable water. TH RESOLUTION : MODIFYING CONTRACT FOR 5 AND WATER STREET PARKING LOT On motion by Mr. Lynch, seco nded by Mr. Schilling, the Resolution Modifying the th Contract for the 5 and Water Street Parking Lot was deferred to the next meeting by the following vote.
