16 <br /> Mr. Caravati said a vendor had suggested that the fee be different for those who sell <br />homemade items, but Mr. Tolbert said Virginia law does not allow a fee based on what is <br />sold. <br /> <br /> Mr. Caravati said this same vendor also recommended designating an area of the mall <br />for crafters, but Mr. Tolbert said this was not the recommen dation of the vendors. <br /> <br /> Mr. Schilling said he had reservations before and a lot of work has gone into making <br />the ordinance and guidelines into an acceptable form. He said that personally some of it <br />seems like over regulation, but he is willing to go forw ard. He said he is bothered by the <br />BAR Chair's efforts to regulate competitors on the mall and said that does not play well with <br />the public. He said if there is an appearance of a conflict then she should recuse herself. <br /> <br /> Mr. Caravati agreed with Mr. Sc hilling and said perhaps a vendor could be appointed <br />to the BAR. <br /> <br /> Mr. Cox said that the BAR spends very little time on vendor issues, but he agrees that <br />if there is an appearance of a conflict then the Chair should be advised accordingly. <br /> <br /> Mr. Lynch made a motion to amend the ordinance as recommended by Mr. Tolbert, <br />Ms. Richards seconded the motion, and the ordinance was amended by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling.
