NOTICE OF SPECIAL MEETING <br /> <br />A SPECIAL MEETING OF THE CHARLOTTESVILLE CITY COUNCIL WILL BE <br />HELD ON Monday, December 15, 2003 AT 6:00 p.m. IN THE Second Floor Conference <br />Room. <br /> <br />THE PROPOSED AGENDA IS AS FOLLOWS: <br /> <br /> Closed session as provided by Section 2.2 - 37 12 of the Virginia Code <br /> <br />BY ORDER OF THE MAYOR BY Jeanne Cox <br /> <br />SECOND FLOOR CONFERENCE ROOM - December 15, 2003 <br /> <br /> Council met in special session on this date with the following members present: <br />Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Absent: Mr. Caravati. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Schilling, Council voted to meet in <br />closed session (Ayes: Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br />Absent: Mr. Caravati) for discussion and consideration of the disposition o f publicly held <br />real property located (1) at the intersection of McIntire and Harris Roads, and (2) on West <br />Main Street and Elsom Street, where discussion in an open meeting would adversely <br />affect the bargaining position or negotiating strategy of the City , as authorized by Section <br />2.2 - 3711(A)(3) of the Virginia Code; and for consultation with legal counsel regarding <br />the negotiation of the terms and conditions of an agreement with the University of <br />Virginia as authorized by Section 2.2 - 3711(A)(7) of the Vir ginia Code. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Schilling, Council certified by the <br />following vote (Ayes: Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br />Absent: Mr. Caravati) that to the best of each Council Member's knowledge, onl y public <br />business matters lawfully exempted from the open meeting requirements of the Virginia <br />Freedom of Information Act and identified in the motion convening the closed session <br />were heard, discussed or considered in the closed session. <br /> <br />COUNCIL CHAMBER - December 15, 2003 <br /> <br /> Council met in regular session on this date with the following members present: <br />Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Absent: Mr. Caravati. <br /> <br />PUBLIC <br /> <br /> Mr. Jock Yellott, 311 E. Market Street, said Council should talk to a lawyer about <br />the legality of conveying property via an easement for the Meadowcreek Parkway. Mr. <br />Yellott said that there is case law showing that the Mayor may have veto power even <br />though the City Charter does not grant a veto power. Mr. Yellott said a three fourths vote <br />is required for a permanent change in property use and recommended that Council ask for <br />a legal opinion from A. E. Dick Howard. <br /> <br /> Mr. Derek Vanderlinde, 713 Palatine Avenue, spoke against the transit terminal. <br />He said he has not receive d answer to question he has posed regarding a traffic study of <br />th th <br />closing 7 Street, where will the Dogwood Festival go if 7 Street is closed, where else <br />will the mall be crossed, where will the extra cost for the project come from; and where <br />will tourists park. He suggested that mini terminals be installed instead. He said this is <br />not a necessary project and will not help the people it is intended to help. He suggested <br />using the south side of Water Street as a new terminal, using the space occupied by <br />A CAC, which has announced that it may relocate, as a waiting area. <br /> <br /> Mr. Lin Shopa, 1439 Westwood Road, said that what he has seen of the McIntire <br />Park plan is exciting and he is enthusiastic about opening up the park to wider uses. He <br />supported rapid move ment toward this type of use. He said the Kellytown Neighborhood <br />Association supports these plans. He suggested that the project start with the trail <br />
