5 <br /> Mr. Robert Cox said that in many cases it is usually too late to resolve issues with <br />family counseling, though it is provided where it has the potential to work. <br /> <br /> Mr. Lynch said he would like to meet further to discuss the issue. <br /> <br />REPORT <br />: CITY MANAGER'S 2003 YEAR END REVIEW <br /> <br /> Mr. O'Connell provided a year - end review, showing a power point presentation of <br />newspaper headlines through the year. <br /> <br /> Mr. Cox said he is impressed with the number of commercial buildin g permits <br />that have been issued during the previous year. <br /> <br /> Ms. Richards said she is also impressed with the number of residential building <br />permits. Ms. Richards pointed out that Charlottesville has joined forced with other cities <br />in Virginia First Cities . She said this group provides hope for the future for improving <br />funding for education. <br /> <br />TH <br />RESOLUTION <br />: AMENDING CONTRACT FOR 5 AND WATER STREET LOT <br /> <br /> Mr. Craig Brown, City Attorney, said an amendment to the contract for <br />th <br />development of the surface parking lot on 5 and Water Street has been proposed. He <br />said the City sold the lot in 1991 and the ownership of the company has changed. He <br />said the new proposal is to increase the residential units and reduce the commercial <br />space. Mr. Brown said the resolut ion also approves the parking lot to be used as paid <br />monthly parking until the property is developed. <br /> <br /> Ms. Richards noted that the change will result in more revenue for the City. She <br />said she supports the change and regrets that the previous owner was n ot able to develop <br />the property. <br /> <br /> Mr. Lynch said he regrets that he is not able to support the resolution. He said the <br />property was sold for half of its assessed value because replacement parking was <br />promised. He said the City essentially took a loss on the property. He said less parking <br />will now be provided. He said we should ask for the original terms or get our money <br />back. <br /> <br /> Mr. Schilling said he shares Mr. Lynch's concerns and asked what rights the City <br />has to take money back or to have the origina l commitment honored. <br /> <br /> Mr. Brown said the City has no contractual right to get funds back. He said in the <br />original proposal 41 privately owed parking spaces were to be provided. The proposal <br />now is for 27 spaces. Mr. Brown said Council can reject the amendment, but he <br />questioned whether the project would get done if they do reject it. <br /> <br /> Mr. Cox said the number of parking spaces was driven by the commercial office <br />space originally proposed. He said that was driving up the cost of the project. Mr. Cox <br />said the new proposal will provide the first new condos in the core of the downtown mall. <br />He said he thinks this is the best spirit of what we are trying to have happen. He said he <br />is comfortable supporting paid parking in the interim. <br /> <br />th <br /> The Resolution A mending the Contract for the 5 and Water Street Lot was <br />approved by the following vote. Ayes: Mr. Cox, Ms. Richards, Mr. Schilling. Noes: <br />Mr. Caravati and Mr. Lynch. <br /> <br />WHEREAS <br />, in 2001 the City of Charlottesville conveyed certain property <br />th <br />identified as Parcel 72 on City Real Estate Tax Map 53, located at the intersection of 5 <br />Street, S.E. and Water Street (the “Property”), to Water Street, LLC pursuant to a <br />contract dated January 3, 2001 (the “Contract”); and, <br /> <br />
