8 <br /> Mr. Caravati asked if the state is near to approaching this problem. <br /> <br /> Mr. Schuyler said there is no mechanism for the state doing it. He said it will be a <br />model for communities coming together to regulat e themselves. He said the legislation <br />has been referred to the Rules Committee and he does not know when the bill will come <br />up. <br /> <br /> Mr. Caravati said it sounds like a wonderful idea, but he would need to hear the <br />City Attorney's opinion on the impact. <br /> <br /> Mr. Brown said that he is not comfortable giving an opinion having just seen the <br />information, but on the surface it does not appear to have regulatory authority. <br /> <br /> Mr. Cox said this is an outgrowth of the Rivanna River Basin Roundtable and the <br />legislation sim ply enables the Commission to be formed. He said the City will have the <br />ability to not participate. <br /> <br /> Mr. Schilling asked for clarification about the City not participating. <br /> <br /> Mr. Schuyler said that the City can choose not to participate if the legislatio n is <br />approved. He said he would guess that if one of the major jurisdictions does not <br />participate the Commission probably will not happen. <br /> <br /> Responding to a question from Mr. Brown, Mr. Schuyler said the legislation has a <br />sunset provision. <br /> <br /> Mr. Lynch mad e a motion to support the letter supporting the legislation to enable <br />creation of a Rivanna River Basin Commission. <br /> <br /> Ms. Richards seconded the motion and said it provides the possibility of reaping <br />benefits without having to commit to the risks. <br /> <br /> The l etter of support for the Rivanna River Basin Commission legislation was <br />approved by the following vote. Ayes: Mr. Cox, Mr. Lynch, Ms. Richards. Noes: Mr. <br />Schilling. Abstaining: Mr. Caravati. <br /> <br /> On motion by Mr. Schilling, seconded by Ms. Richards, Cou ncil voted to meet in <br />closed session for consultation with legal counsel about probable litigation related to <br />damage allegedly resulting from storm water drainage from a City street, as authorized by <br />Section 2.2 - 3711(A)(7) of the Virginia Code; and discuss ion and consideration of the <br />acquisition of real property on South Street, where discussion in an open meeting would <br />adversely affect the bargaining position or negotiating strategy of the City, as authorized <br />by Section 2.2 - 3711(a)(3) of the Virginia Code. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, Council certified by the <br />following vote (Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards.
