12 <br /> Mr. Caravati asked what happens if Adelphia has not compl eted its upgrade by <br />2006, and Ms. Knake said that the agreement with the community television station will <br />still expire, but it could come back to Council for renewal. <br /> <br /> Mr. Schilling expressed concern about article 4, and Ms. Knake said that under <br />federal law Adelphia cannot require School Board meetings to be broadcast. Ms. Knake <br />said that the operators of the station have strongly agreed to broadcast the School Board <br />meetings. She noted that the agreement allows Council to end the agreement with 12 <br />mont hs' notice for a community need. <br /> <br /> Mr. Denny King, partner in the television project, said that they have a very deep <br />seeded interested in education and their intention is to provide news and coverage of <br />community events. He gave his word that he will do what he says they are going to do. <br /> <br /> Mr. Bob Sigman, partner in the project, said that this speaks to the mission <br />statement of the television station and feels that School Board meetings are very <br />important. <br /> <br /> Ms. Richards said that the menu of programming will be a tremendous asset to the <br />community and will enhance communication and access to information. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Schilling, the resolution approving <br />the agreement for a community television station was approved by the foll owing vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />WHEREAS <br />, the City of Charlottesville (“City”) entered into a Cable Franchise <br />Agreement with Chelsea Communications, L.L.C. D/B/A Adelphia Cable <br />Communications (hereinafter “Adelphia”) effective January 1, 2004 – December 31, <br />2013; and <br /> <br />WHEREAS <br /> , the Cable Franchise Agreement requires that Adelphia make <br />available for use by the City, without charge, a minimum of one (1) activated Channel for <br />non - commercial Gover nmental programming, a minimum of one (1) activated Channel <br />for non - commercial public access programming and a minimum of one (1) activated <br />Channel for non - commercial educational programming for educational institutions within <br />the City; and <br /> <br />WHEREAS <br /> , Cha nnel 14 is currently designated for non - commercial educational <br />programming but is underutilized; and <br /> <br />WHEREAS <br />, Adelphia currently does not have capacity in its present bandwidth <br /> <br />for additional channel capacity but is expected to have additional capacity n o later than <br />December 31, 2006; and <br /> <br />WHEREAS <br />, the City desires to make Channel 14 available for commercial <br />community programming by a low power television service station for a limited time not <br />longer than such time as Adelphia’s system is upgraded with ad ditional channel capacity; <br />and <br /> <br />WHEREAS <br /> , Adelphia has indicated a willingness to amend or otherwise address <br />the relevant provisions of the Cable Franchise Agreement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> that the City Manager is authorized <br />to execute a Side Le tter Agreement with Adelphia as approved by the City Attorney to <br />allow use of Channel 14 for a community television station until December 31, 2006. <br /> <br />RESOLUTION <br />: HOUSING POLICY TASK FORCE <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, g ave a brief <br />presentation on the report of the Housing Policy Task Force which included housing data <br />in the Charlottesville region; housing costs in the region; information about where City <br />employees live; and low income housing issues. <br />
