RESOLUTION RE: <br />CLOSING VINE STREET <br /> <br />RESOLUTION RE: <br />ANNEXATION <br /> <br /> WHEREAS, ALL PROPERTY OWNERS ABUTTING ON BOTH SIDES OF VINE STREET FROM <br /> <br />ITS INTERSECTION ON THE WEST SIDE OF RANDOLPH STREET WESTERLY TO ITS TERMINAL POINT~ <br /> <br />DESIRE FOR SAID STREET TO BE CLOSED AND VACATED; AND <br /> <br /> WHEREAS~ THE CITY PLANNING COMMISSION HAS RECOMMENDED SUCH CLOSING;~AND <br /> WHEREAS, THE COUNCIL OF THE CITY OF CHARLOTTESVILLE IS WILLING TO CLOSE <br /> <br />AND VACATE SAID STREET$ <br /> <br /> NOW THEREFORE~ BE 'IT RESOLVED BY THE COUNCIL OF THE CITY OF CHARLOTTES- <br />VILLE THAT VINE STREET FROM ITS INTERSECTION ON THE WEST SIDE OF RANDOLPH STREET TO ITS <br />END} APPROXIMATELY 375 FEET WEST OF SAiD INTERSECTION, BE AND IT IS HEREBY CLOSED AND <br />VACATED} THE TITLE TO THE LAND INCLUDED IN SUCH STREET REVERTING TO THE ABUTTING PROPERTY <br />OWNERS AS THEIR INTERESTS MAY APPEAR~ AND <br /> BE IT FURTHER RESOLVED, THAT THE CLERK OF THE COUNCIL OF THE CiTY OF <br />CHARLOTTESVILLE BE AND HE IS HEREBY DIRECTED TO RECORD THIS RESOLUTION OF STREET CLOSING <br /> IN THE CLERK'S OFFICE OF THE CORPORATION COURT OF THE CITY OF CHARLOTTESVILLE; <br /> ON MOTION BY MR. MOUNT~ SECONDED BY MR. LEE~ THE FOLLOWING RESOLUTION WAS UNANIMOUSLY <br /> ADOPTED: <br /> <br /> 'W1-1EREAS} THE COUNCIL OF THE CITY OF CHARLOTTESVILLE AND BOARD OF <br /> <br /> SUPERVISORS OF ALBEMARLE COUNTY HAVE> AS PREVIOUSLY STATED TO THE PUBLIC} AGREED TO <br /> COMPROMISE THE ANNEXATION SUIT PRESENTLY PENDING IN THE COURTS OF THIS STATE~ AND <br /> WHEREAS> THE COUNCIL IS OF UNANIMOUS AGREEMENT THAT THE COMPROMISE <br /> <br /> AS AGREED TO IS FOR THE BEST INTEREST OF ALL PARTIES CONCERNED~ <br /> N~¢, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> CHARLOTTESVILLE THAT THE C'ITY ENDORSE THE COMPROMISE REACHED BETWEEN THIS COUNCIL <br /> AND THE BOARD OF SUPERVISORS OF ALBEMARLE COUNTY ON JULY 27} 1961} WHICH COMPROMISE <br /> IN ESSENCE AMENDS THE DECEMBER 1~ 1960 ORDER OF ANNEXATION AS FOLLOWS: <br /> 1. SPERRY RAND CORPORATION AND UNITED STATES INSTRUMENT CORPORATION <br /> WILL REMAIN COUNTY PROPERTY. KNOLLWOOD} HESSIAN HILLS SUBDIVISION AND ALBEMARLE VETERINARY <br /> HOSPITAL ON HYDRAULIC ROAD~ AND THE LAND GENERALLY LYING BETWEEN SAID HOSPITAL AND HESSIAN <br /> HILLS SUBDIVISION WILL REMAIN COUNTY PROPERTY} THAT THE BOUNDARY LINE FOR THE ANNEXATION <br /> <br /> AREA AND TO THE NORTHEAST WILL BE THE WESTERN SIDE OF THE SOUTHERN RAILROAD RIGHT OF WAY <br /> <br /> SO AS TO LEAVE THAT PORTION OF THE RAILROAD IN THE COUNTY} THAT THE BOUNDARY LINE WILL BE <br /> <br /> MOVED TO THE NORTH SIDE Of THE ROAD RUNNING FROM PARK STREET EXTENDED TO CARTERTON. ALL <br /> <br /> OTHER ANNEXATION LINES WILL REMAIN AS FIXED BY THE ORDER OF ANNEXATION DATED DECEMBER l} 1960. <br /> <br /> 2. THE CiTY WILL RECEIVE A CREDIT OF 446,576 FROM THE COUNTY TO BE APPLIED <br /> <br /> AGAINST THE COUNTY'S DEBT ASSUHED BY THE CITY. <br /> <br /> 3. THAT THE CiTY WILL NOT BE REQUIRED TO PAY 415,600 FOR THE SANITARY <br /> SEWERS IN THE WOOLEN MILLS SANITARY DISTRICT AS PREVI-OUS~Y ORDERED ON DECEMBER 1, 1960. <br /> 4. THAT WiTH THE CONSENT OF THE CITY SCHOOL BOARD STUDENTS IN THE ANNEXED <br /> AREA MAY BE ASSIGNED BY THE COUNTY SCHOOL BOARD TO ATTEND CITY SCHOOLS COMMENCING <br /> SEPTEMBER 1962~ AT THE EXPENSE OF THE COUNTY OF ALBEMARLE UNTIL JANUARY 1~ 1963. <br /> ~. THAT THE CITY COMMENCE THE CONSTRUCTION OF THE GREENBRIER ELEMENTARY <br /> <br /> SCHOOL IMMEDIATELY AFTER THE ANNEXATION ORDER IS ENTERED SO THAT IT WILL BE READY FOR <br /> OCCUPANCY BY SEPTEMBER~ 1962. <br /> <br /> 6. THAT THE CITY WILL CONTINUE TO EXTEND UTILITIES IN THE PROPOSED <br /> <br /> ANNEXED AREA ON THE SAME BASIS AS NAS BEEN FOLLOWED FOR THE PAST SIX MONTHS. <br /> 7. THAT ANNEXATION WILL BECOME EFFECTIVE MIDNIGHT DECEMBER 31} 1962. <br /> BE IT FURTHER RESOLVED THAT THIS COUNCIL DIRECTS SAMUEL H. WtLLIAMS~ ESQ. <br /> AND THE CITY ATTORNEY TO SEEK AN AMENDED ORDER OF ANNEXATION ALONG THE LINES HEREINABOVE <br /> <br /> <br />
