RESOLUTION RE: <br />EXTENSION OF CITY WATER <br />OUTSIDE CITY LIMITS <br /> <br />APPROPRIATION - UTILITY <br />LINES IN ROLLING HILLS <br /> <br />HATTER RE: TERM OF <br />OFFICE - AIRPORT CONN. <br />REFERRED TO COMMITTEE <br /> <br />'ExeCUTIVE SESSION <br /> <br />REPORT OF CITY HGRo RE: <br />CONSTRUCTION IN ANNEXED <br />AREA - STOP WORK ORDERS <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY Of CHARLOTTESVILLE <br /> <br /> THAT IN ADDITION TO THE POLICY HERETOFORE MADE BY THIS COUNCIL <br /> CONCERNING THE EXTENSION OF CITY WATER OUTSIDE THE CITY LIMITS NO <br /> FUTURE EXTENSION OF CITY UTILITIES SHALL BE MADE OUTSIDE THE EXIST- <br /> ING CITY LIMITS UNTIL THE SUBDIVIDER SEEKING SUCH EXTENSION~ AS A <br /> CONSIDERATION OF THE EXTENSION OF CITY UTILITIES OUTSIDE THE CITY <br /> LIMITS TO HIS SUBDIVISION, PLACES RESTRICTIONS~ AS COVENANTS RUNNING <br /> WITH THE LAND, ON EITHER THE PLAT Of THE SUBDIVISION OR IN THE FIRST <br /> DEED THAT GOES TO RECORD CONCERNING THE SUBDIVISION, THAT THERE WILL <br /> BE NO USES PERMITTED IN THE SUBDIVISION EXCEPT THOSE SET FORTH IN <br /> SECTION 9 OF ARTICLE IV OF APPENDIX Ii OF THE CODE OF THE CITY OF <br /> CHARLOTTESVI-LLE~ UNLESS, THE COUNCIL EXPRESSLY APPROVES A DIFFERENT <br /> USE IN THE GRANT OF THE EXTENSION· IT WILL SE FURTHER STATED ON <br /> SUCH PLAT OR IN SUCH DEED THAT THESE RESTRICTIONS SHALL ONLY BE <br /> APPLICABLE TO THE SUBDIVISION UNTIL SUCH TIME AS A VALID COUNTY <br /> OR CITY ZONING ORDINANCE COVERING SUCH SUBDIVISION IS ENACTED. <br /> <br /> A COMMUNICATION REQUESTING CITY UTILITIES FOR WESTFIELD SUBDIVISION WAS <br /> PRESENTED AND ON NOTION BY HR. HOUNT~ SECONDED BY HR. SCRIBNER, ACTION WAS <br /> DEFERRED UNTIL JANUARY 21~ ]963. <br /> <br /> THE RESOLUTION APPROPRIATING ~2~673.26 FOR THE ClTYtS SHARE OF THE COST <br /> <br />OF UTILITIES IN ROLLING HILLS WHICH WAS OFFERED AT THE MEETING OF THE COUNCIL <br /> <br />ON DECEMBER ]7~ ]962 WAS ADOPTED BY THE FOLLOWING RECORDED VOTE: AYES= HR. HAGGERTY~. <br />HR. LEE~ HR. HOUNT~ HR. PONTON AND HR. SCRIBNER. NOES: NONE. <br /> <br /> A COMMUNICATION FROM THE ALBEMARLE COUNTY BOARD OF SUPERVISORS RECOMMENDING <br />THAT THE TERMS OF THE MEMBERS OF THE JOINT AIRPORT COMMISSION BE LIMITED TO <br />ONE THREE YEAR TERM WAS REFERRED TO A COMMITTEE COMPOSED OF HR. SCRIBNER AND <br />HR. LEE FOR RECOMMENDATION. <br /> <br /> ON NOTION BY-HR. HOUNT~ SECONDED BY HR; SCRIBNER, THE COUNCIL VOTED TO GO <br /> <br />INTO EXECUTIVE SESSION BY THE FOLLOWING RECORDED VOTE: AYES: HR. HAGGERTY, HR. <br /> <br />LEE~ HR. MOUNT, HR. PONTON AND HR. SCRIBNER. NOES: NONE. <br /> <br /> THE FOLLOWING REPORT OF THE CITY HANAGER WAS PRESENTED AND DISCUSSED: <br /> <br />TO THE MEMBERS OF THE COUNCIL <br />CiTY OF CHARLOTTESVILLE, VIRGINIA <br /> <br />GENTLEMEN: <br /> <br />JANUAR~ 7~ 1963 <br /> <br /> WE HAVE CHECKED ALL OF THE BUILDINGS UNDER CONSTRUCTION IN THE <br />ANNEXED AREA ON WHICH STOP WORK ORDERS WERE ISSUED AND WE HAVE FOUND TWO <br />BUILDINGS ON WHICH WE BELIEVE THE STOP ORDER SHOULD BE WITHDRAWN AT THIS <br />TIME~ PROVIDED THE OWNERS WILL AGREE IN WRITING TO CONSTRUCT THE BUILDINGS <br />SO AS TO COMPLY WITH THE CITY BUILDING, PLUMBING AND ELECTRICAL CODES~ AND <br />WILL ALSO AGREE TO COMPLY WITH THE CITYtS OFF-STREET PARKING REQUIREMENTS. <br /> <br />THESE BUILDINGS ARE: <br /> <br />APARTMENT BUILDING ~3 oN PARK STREET, EXTENDED. OWNER: ELMER E. <br />BURRUSS. BUILDING WAS ABOUT READY FOR ROOF WHEN STOP ORDER WAS <br />SERVED AND OWNER WAS PERMITTED AT HIS RISK TO PUt ON TEMPORARY <br />ROOF FOR PROTECTION OF THE LOWER FLOORS. THIS BUILDING IS ABOUT <br />2~ COMPLETED. <br /> <br />APARTMENT BUILDING ON NORTH BERKSHIRE ROAD. OWNER: FINANCE AND <br />INVESTMENT CORPORATION OF AMERICA. TWO OF THE THREE STORIES OF THIS- <br />BUILDING HAVE BEEN ERECTED. THE OWNER WAS PERMITTED AT HIS RISK TO <br />INSTALL WINDOWS AND PLACE PLASTIC COVER OVER SECOND STORY FOR PROTECTION. <br />BUILDING IS ABOUT 25~ COMPLETED. <br /> <br /> BOTH OF THE ABOVE OWNERS MAY~ IN MY OPINION~ HAVE A ~VESTED RIGHTt~ <br />TO CONTINUE CONSTRUCTION, DUE TO THE AMOUNT OF CONSTRUCTION WHICH HAS ALREADY <br />TAKEN PLACE. IN VIEW OF THIS~ AND SINCE THE CITYtS INTERESTj IN BOTH INSTANCES <br />WILL IN NY OPINION~ BE PROTECTED IF THE CITY BUILDING~ PLUMBING, ELECTRICAL AND <br />PARKING CODES ARE COMPLIED WI'THj ~ SUGGEST THAT THE STOP ORDER BE WITHDRAWN ON <br />BOTH OF THESE BUILDINGS~ PROVIDED OF COURSE~ THAT THE OWNERS AGREE TO COHPLY <br />WITH THE CONSTRUCTION AND INSTALLATION REQUIREMENTS OF THE CITYtS AFOREMENTIONED <br /> <br /> <br />
