RESOLUTION ADOPTED- <br />ORDERED PRESENTED <br />AND READ AT PUBLIC <br />HEARING <br /> <br />PUBLIC HEARING RE: <br />PROPOSED AMENDMENTS <br />TO CITY CHARTER <br /> <br /> 10. ~T IS THE CONSIDERED OPINION OF THE OFFICIALS OF THIS CITY THAT <br /> <br />THE COSTS FOR RIGHTS OF WAY~ DAMAGES AND LEGAL COSTS FOR CONDEMNATION <br />PROCEEDINGS FOR LAND TO CONSTRUCT LINES ~B~ OR ~CB~ IN THE VICINITY OF <br />THIS CITY AND IN ALBEMARLE COUNTY WOULD BE FAR GREATER THAN IT WOULD BE <br />FOR LINE ~C~. THE NORTHERN AREA OF THE CITY AND ADJOINING SECTION OF <br />ALBEMARLE COUNTY IS DEVELOPING RAPIDLY INTO HIGH RESIDENTIAL SUBDIVISIONS <br />AND PRIOR TO THE TIME THAT THE RIGHTS OF WAY COULD BE SECURED MANY MORE <br />BUILDINGS AND SUBDIVISIONS WILL HAVE BEEN CONSTRUCTED IN THE AREA AND IT <br />IS A MATTER OF RECORD THAT THE LARGE ESTATES ON THE NORTH AND NORTHWEST <br />OF THE CITY ARE BITTERLY OPPOSED TO THE CONSTRUCTION OF AN INTERSTATE <br />ROUTE THROUGH OR NEAR THEIR PROPERTY SO THAT THEY WILL SURELY BE UNWILLING <br />SELLERS AND THE DAMAGES MAY BE VERY HIGH AND <br /> <br /> 17. ROUTE ~C~t THROUGH INTERCHANGE ON 29-29A WOULD SURELY PROVIDE <br /> <br />BETTER SERVICE BETWEEN THIS CITY AND THE CITIES OF WAYNESBORO AND STAUNTON) <br /> <br />AND <br /> <br /> 12. THE ECONOMICAL BENEFITS WHICH WOULD ACCRUE TO THIS GROWING CITY <br /> <br />ALONE WOULD MORE THAN OFFSET THE ADDITIONAL INITIAL COST OF LINE ~C~ AND THE <br />COUNCIL OF THIS CITY STRONGLY URGES THAT ROUTE 64 BE CONSTRUCTED GENERALLY <br />ALONG LINE ~C~ AS SOON AS IS PRACTICAL AND POSSIBLE. <br /> <br /> A ~OTION BY MR. SCRIBNER~ SECONDED BY MR. ~OUNT~ THAT THE FOREGOING RESOLUTION <br />BE ADOPTED AND THAT A COPY BE PRESENTED AND READ INTO THE MINUTES OF THE PUBLIC <br />HEARING TO BE HELD ON DECEMBER ~TTH BY THE STATE HIGHWAY DEPARTMENT AND THAT THE <br />CITIZENS OF THIS CITY BE URGED TO SUPPORT THE LOCATION OF ~OUTE 6~ ON THE SOUTHERN <br /> <br />SIDE OF THE CITY IN THE GENERAL LOCATION OF LINE ~C~ WAS UNANIMOUSLY ADOPTED. <br /> <br /> ON MOTION THE MEETING ADJOURNED. <br /> <br /> COUNCIL CHAMBER DECEMBER 16, 1963 <br /> <br /> THE COUNCIL MET IN REGULAR SESSION ON THIS DATE WITH THE FOLLOWING MEMBERS <br />PRESENT: MR. HAGGERTY~ MR. LEE~ MR. HOUNT~ MR. PONTON AND MR. SCRIBNER. <br />ABSENT: NONE. <br /> <br /> THE MINUTES Of THE MEETING Of DECEMBER 2, 1963 AND DECEMBER 10, 1963 WERE READ <br />AND APPROVED, <br /> <br /> A PUBLIC HEARING WAS HELD ON THIS DATE ON PROPOSED AMENDMENTS TO THE CITY CHARTER <br />AS FOLLOWS: <br /> <br /> SECTION 33 WHICH WOULD PROVIDE THAT THE JUDGE AND ASSISTANT JUDGE OF HUNICIPAL <br />COURT WILL BE APPOINTED BY THE JUDGE OF CORPORATION COURT. THE PROPOSED AMENDMENT <br />WOULD ALSO PROVIDE THAT THE MUNICIPAL COURT WOULD NOT HAVE TO BE HELD ON SATURDAYS <br />AND THAT CIVIL ACTIONS IN SUCH COURT WOULD BE FILED AND PRESERVED IN THAT COURT. <br />T~E PROPOSALS ALSO PROVIDEO THAT ADDITIONAL SECTIONS OF THE HODEL CHARTER BE ADDED <br />TO THE CITY CHARTER AS FOLLOWS: <br /> <br />SECTION 15.1-849. <br /> <br /> PROVIDING THAT PAYMENTS UNDER THE CITY'S RETIREMENT SY$TEM WOULD NOT BE <br /> SUB,EOT TO GARNISHMENT~ LEVY OR ATTACHMENT~ <br /> <br />SECTION 15:1-856. <br /> <br /> PROVIDING THAT THE CITY~ WITHOUT LIABILITY TO THE OWNER THEREOF~ COULD <br /> PREVENT THE MAINTENANCE AND OPERATION OF SEPTIC TANKS WHICH CONTRIBUTED <br /> OR WOULD BE LIKELY TO CONTRIBUTE TO THE POLLUTION OF THE CITY'S WATER <br /> SUPPLY. <br /> <br />SECTION 15.1-882 <br /> <br /> <br />
