BONDS <br />SERIES OF 1963 <br /> <br /> THE LEGAL OPINION OF WOOD, KING~ DAWSON AND LOGAN RE: ~3,500,000.00 SCHOOL <br />IHPROVEHENT BONDS~ SERIES OF 1963 WAS PRESENTED AND ORDERED SPREAD IN THE MINUTES <br /> <br />OF THIS MEETING: <br /> <br />PAUL D.SUMMERS~ JR., ESQ. <br />CITY ATTORNEY <br />CHARLOTTESVILLE, VIRGINIA <br /> <br />JUNE t2, 1964 <br /> <br />DEAR SIR:- <br /> <br />CITY OF CHARLOTTESVILLE~ VIRGINIA~ SCHOOL IHPROVEMENT <br /> BONDS - SERIES OF 1963, ~3~500.000. <br /> <br /> AT THE REQUEST OF THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA <br />WE HAVE EXAMINED INTO THE VALIDITY OF AN ISSUE OF ~3,500~000 SCHOOL IMPROVEMENT <br />BONDS - SERIES OF 1963, oF THE CITY OF CHARLOTTESVILLE~ VIRGINIA, DATED JUNE 1 <br />1964, NUHBERED FROM 1 TO 700~ 'INCLUSIVE~ OF THE DENOMINATION OF ~5)000 EACH~ <br />PAYABLE SERIALLY IN NUMERICAL ORDERS175,000 BONDS ON JUNE 1 IN EACH OF THE <br />YEARS 7965 TO 1984, INCLUSIVE~ WITHOUT OPTION OF PRIOR REDEMPTION, BONDS <br />MATURING IN THE YEARS 796S TO 7969~ INCLUStVE~ BEARING INTEREST AT THE RATE <br />OF THREE AND ONE-QUARTER PER CENTUM PER ANNUM~ BONDS MATURING IN THE YEARS <br />1970 TO 1975~ INCLUSIVE~ BEARING INTEREST AT THE RATE OF TWO AND EIGHTY <br />HUNDREDTHS PER CENTUM PER ANNUM~ BONDS MATURING IN THE YEARS 1976 TO 7979, <br />INCLUSIVE~ BEARING INTEREST AT THE RATE OF TWO AND NINETY HUNDREDTHS PER CENTUM <br />PER ANNUH, AND BONDS MATURING IN THE YEA~S 7980 TO ~9~4, INCLUSIVE, BEARING <br />INTEREST AT THE RATE OF THREE PER CENTUM PER ANNUM, PAYABLE SEMIANNUALLY JUNE <br />AND DECEMBER 7; SAID BONDS RECITING THAT THEY ARE ISSUED FOR THE PURPOSE OF <br />SITE ACQUISITION, CONSTRUCTION~ AND FURNISHING OF TWO ADDITIONAL SCHOOLS AND <br />OTHER SCHOOL IMPROVEHENTS UNDER AND BY VIRTUE OF AND IN FULL CONFORMITY WITH <br />AND PURSUANT TO AN ORDINANCE OF THE CITY OF CHARLOTTESVILLE ADOPTED SEPTEMBER <br />30~ 1963~ AND SPREAD IN ORDINANCE BOOK 4~ PAGES 7 AND 2) AND APPROVED BY THE <br />VOTERS OF THE CITY AT AN ELECTION HELD FOR THAT PURPOSE ON NOVEMBER 5, 1963, IN <br />ACCORDANCE WITH THE CHARTER OF THE CITY OF CHARLOTTESVILLE AND THE CONSTITUTION <br />AND LAWS OF THE STATE OF VIRGINIA AND PURSUANT TO CHAPTER ~9.7 OF THE CODE OF <br />VIRGINIA OF 7950~ AS AMENDED~ - WE HAVE EXAHINED THE CONSTITUTION AND STATUTES <br />OF THE STATE OF VIRGINIA~ INCLUDING THE CHARTER OF THE CITY OF CHARLOTTESVILLE~ <br />AND CERTIFIED COPIES OF PROCEEDINGS OF THE COUNCIL OF SAID CITY AUTHORIZING <br />THE ISSUANCE OF SAID BONDS~ ALSO AN EXECUTED BOND OF SAID ISSUE~ NO. <br /> <br /> ~N OUR OPINION SAID BONDS HAVE BEEN AUTHORIZED AND ISSUED IN ACCORDANCE <br />WITH THE CONSTITUTION AND STATUTES OF THE STATE OF VIRGINIA, INCLUDING THE <br />CHARTER OF THE CITY OF CHARLOTTESVILLE~ AND CONSTITUTE VALID AND LEGALLY <br />BINDING OBLIGATIONS OF THE CITY OF CHARLOTTESVILLE~ VIRGINIA~ AND SAID CITY <br />HAS PO~ER AND IS OBLIGATED TO LEVY AD VALOREM TAXES FOR THE PAYMENT OF SAID <br />BONDS AND THE INTEREST THEREON UPON ALL PROPERTY WITHIN SAID CITY~ SUBJECT <br />TO TAXATION BY SAID CITY~ ~ITHOUT LIMITATION OF RATE OR AHOUNT. <br /> <br /> IT IS ALSO OUR OPINION THAT THE INTEREST ON SAID BONDS IS EXEMPT FROM <br />TAXATION BY THE UNITED STATES OF AMERICA UNDER THE CONSTITUTION OF THE UNITED <br />STATES AS NOW IN FORCE, UNLESS SUCH TAX IS CONSENTED TO BY THE STATE OF VIRGINIA) <br />AND THAT SUCH INTEREST IS EXEMPT FROM SUCH TAXATION UNDER THE EXISTING ACTS OF <br />CONGRESS. <br /> <br />BEECHWOOD RD. & DELL <br />LANE ACCEPTE~ INTO <br />CITY ST. Lo KNIGHT REQUESTING THAT A PORTION OF <br /> <br />BEECH~OOD DRIVE~ AND DELL LANE I'N IDLEWOOD SUBDIVISION BE ACCEPTED INTO THE CITY <br />STREET SYSTEM FOR MAINTENANCE. THE STREET COMMITTEE RECOMMENDED THE ACCEPTANCE <br /> <br />OF THESE STREETS. ON MOTION BY MR. SCRIBNER~ SECONDED BY MR. PONTON, THE FOREGOING <br />RECOMMENDATION WAS UNANIMOUSLY ADOPTED. <br /> <br /> THE WELFARE REPORT FOR THE MONTH OF MAY, ~96~ WAS PRESENTED AND ORDERED FILED <br /> <br />WiTH THE MINUTES OF THIS MEETING. <br /> <br /> ON MOTION THE MEETING ADJOURNED. <br /> <br />COUNCIL CHAMBER - JULY 6~ 1964 <br /> <br /> THE COUNCIL MET IN REGULAR SESSION ON THIS DATE WITH THE FOLLOWING MEHBERS PRESENT: <br /> <br />MR.
