HAGGERTY~ THE FOLLOWING RESOLUTION <br /> WAS UNANIMOUSLY ADOPTED: <br /> <br /> WHEREAS, THE CITY MANAGER HAS ENDEAVORED TO OBTAIN A SANITARY SEWER <br /> <br /> LINE EASEMENT IN ORDER TO PROVIDE SANITARY SEWER SERVICE TO A PORTION OF CITY <br /> PROPERTY LOCATED BETWEEN PIEDMONT AVENUE AND THE SOUTHERN RAILWAY RIGHT OF WAY~ <br /> AND <br /> <br /> WHEREAS, FOR TOPOGRAPHIC REASONS THE ONLY FEASIBLE LOCATION FOR THIS <br /> GRAVITY SANITARY SEWER LINE IS WITHIN THE SOUTHERN RAILWAY RIGHT OF WAY, AND <br /> <br /> WHEREAS, SOUTHERN RAILWAY HAS DECLINED~ WITHOUT STATING ANY REASONS <br /> THEREFOR~ TO PERMIT THE CITY TO RUN THIS SANITARY SEWER LINE <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />CHARLOTTESVILLE THAT THE CiTY ATTORNEY BE AND HE tS HEREBY DIRECTED TO SEEK A <br />CERTIFICATE OF PUBLIC NECESSITY OR ESSENTIAL PUBLIC CONVENIENCE FROM THE <br />STATE CORPORATION COMMISSION AS PROVIDED BY SEC. 25-233~ VIRGINIA CODE ANN.~ <br />AND THEREAFTER TO ACQUIRE BY EMINENT DOMAIN PROCEEDINGS THE NECESSARY SANITARY <br />SEWER EASEMENT FROM THE SOUTHERN RAILWAY. <br /> <br /> AN ORDINANCE ENTITLED "AN ORDINANCE AMENDING AND REENACTING SECTION 61 OF <br /> <br />CHAPTER 19 ENTITLED 'REFRIGERATORS~ ETC. - DISCARDED OR ABANDONED" OF THE CODE <br /> <br />OF THE CITY OF CHARLOTTESVILLE, 1959," WHICH WAS OFFERED AT THE MEETING OF THE <br /> <br />COUNCIL ON NOVEMBER 15~ 1965~ WAS ADOPTED~ AS AMENDED~ BY THE FOLLOWING RECORDED <br />VOTE: AYES: MR. HAGGERTY, MR. PONTON AND MR. SCRIBNER. NOES: NONE. <br /> <br /> ON NOTION BY MR. HAGGERTY~ SECONDED BY MR.
