MR. FRED ROBINSON OF HARLAND BARTHOLOMEW AND ASSOCIATES EXPLAINED THE <br />PROPOSED AMENDMENT I'N DETAIL AFTER WHICH AN OPPORTUNITY WAS AFFORDED EVERYONE PRESENT <br />TO PRESENT THEIR VIEWS. MR. ERWIN $OLOMON~ ATTORNEY REPRESENTING MR, WALTER FOWLER~ <br />HR. BRAXTON FOWLER AND MRS. WINSLOW FOWLER CLARK SPOKE IN OPPOSITION TO THE INCLUSION <br />OF HIS CLIENTIS PROPERTY. VOGT; <br /> <br />RESOLUTION OF THE COUNCIL OF THE CITY OF CHARLOTTESVILLE APPROVING <br />THE REDEVELOPMENT PLAN AS AMENDED BY AMENDMENT NO. t AND THE <br />FEASIBILITY OF RELOCATION FOR PROJECT NO, VA, R-12 <br /> <br /> WHEREAS~ UNDER THE PROVISIONS OF TITL~ I OF THE HOUSING ACT OF 1949~ AS <br />AMENDED~ THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT IS AUTHORIZED TO PROVIDE <br />FINANCIAL ASSISTANCE TO LOCAL PUBLIC AGENCIES FOR UNDERTAKING AND CARRYING OUT <br />REDEVELOPMENT PROJECTSS AND <br /> <br /> WHEREAS~ It IS PROVIDED IN SUCH ACT THAT CONTRACTS FOR AID THEREUNDER <br />SHALL REQUIRE THAT THE REDEVELOPMENT PLAN FOR THE RESPECTIVE PROJECT AREA BE <br />APPROVED BY THE GOVERNING BODY OF THE LOCALITY IN WHICH THE PROdECT IS SITUATED <br />AND THAT SUCH APPROVAL INCLUDE FINDINGS BY THE GOVERNING BODY THAT: <br /> <br />THE FINANCIAL AID TO BE PROVIDED IN THE CONTRACT IS NECESSARY TO <br />ENABLE THE PROJECT TO BE UNDERTAKEN IN ACCORDANCE WITH THE <br />REDEVELOPMENT PLANS <br /> <br />THE REDEVELOPMENT PLAN WILL AFFORD MAXIMUM OPPORTUNITY~ CONSISTENT <br />WITH THE SOUND NEEDS OF THE LOCALITY AS A WHOLE~ FOR THE REDEVELOP- <br />MENT OF THE REDEVELOPMENT AREA BY PRIVATE ENTERPRISES <br /> <br />THE REDEVELOPMENT PLAN CONFORMS TO A GENERAL PLAN FOR THE DEVELOPMENT <br />OF THE LOCALITY AS A WHOLE~ AND <br /> <br />THE REDEVELOPMENT PLAN GIVES DUE CONSIDERATION TO THE PROVISION OF <br />ADEQUATE PARK AND RECREATIONAL AREAS AND FACILITIES~ AS MAY BE <br />DESIRABLE FOR NEIGHBORHOOD IMPROVEMENT~ WITH SPECIAL CONSIDERATION <br />FOR THE HEALTH~ SAFETY~ AND WELFARE OF CHILDREN RESIDING IN THE <br />GENERAL VICINITY OF THE SITE COVERED BY THE PLANS AND <br /> <br /> WHEREAS~ THE CHARLOTTESVILLE REDEVELOPMENT AND HOUSING AUTHORITY (HEREIN <br />CALLED THE "LOCAL PUBLIC AGENCY~') HAS ENTERED INTO A LOAN AND GRANT CONTRACT FOR <br />FINANCIAL ASSISTANCE UNDER SUCH ACT WITH THE UNITED STATES OF AMERICA~ ACTING BY <br />AND THROUGH THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT~ PURSUANT TO WHICH FEDERAL <br />FUNDS WERE PROVIDED FOR THE REDEVELOPMENT PROJECT IDENTITIED AS ~'VlNEGAR HILL PROJECT~ <br />PROJECT NO. VA. R-12'~ AND ENCOMPASSING THE AREA DESCRIBED ON THE ATTACHED BOUNDARY <br />DESCRIPTION IN THE CiTY OF CHARLOTTESVILLE~ STATE OF VIRGINIA (HEREIN CALLED THE <br />~LOCALITY'~)S AND <br /> <br /> WHEREAS, THE LOCAL PUBLIC AGENCY OBTAINED THE CONCURRENCE OF THE SECRETARY <br />OF HOUSING AND URBAN DEVELOPMENT TO COMMENCE AND PREPARE WiTH FINANCIAL ASSISTANCE~ <br />AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR SUCH PROJECT AREAS AND <br /> <br /> WHEREAS~ THE LOCAL PUBLIC AGENCY HAS APPLIED FOR ADDITIONAL FINANCIAL <br />ASSISTANCE UNDER SUCH ACT AND PROPOSES TO ENTER INTO AN AMENDED LOAN AND GRANT <br />CONTRACT WITCH THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE UNDERTAKING OF~ <br />AND FOR MAKI,NG AVAILABLE ADDITIONAL F~NANCIAL ASSISTANCE FOR) THE PROJECT; AND <br /> <br /> WHEREAS~ THE LOCAL PUBLIC AGENCY HAS HERETOFORE MADE DETAILED STUDIES OF THE <br />LOCATION~ PHYSICAL COND~TION OF STRUCTURES~ LAND USE~ ENVIRONMENTAL INFLUENCES~ AND <br />SOClAL~ CULT[URAL AND ECONOMIC CONDITIONS OF THE PROdECT AREA AND HAS DETERMINED THAT <br />THE AREA AS AMENDED IS A SLUM~ BLIGHTED AND DETERIORATING AREA AND THAT tt IS DETRIMENTAL <br />AND A MENACE TO THE SAFETY~ HEALTH~ AND WELFARE OF THE INHABITANTS AND USERS THEREOF AND <br />OF THE LOCAL~ITY AT LARGE~ BECAUSE OF DILAPIDATION) OBSOLESCENCE~ OVERCROWDING~ FAULTY <br />ARRANGEMENT OF DESIGN~ LACK OF VENTILATION~ LIGHT~ AND SANITARY FACILITIES~ EXCESSIVE <br />LAND COVERAGE~ DELITERIOUS LAND USES~ OR OBSOLETE LAYOUT~ OR A COMBINATION OF THESE OR <br />OTHER FACTOR$~ AND THE MEMBERS OF THIS GOVERNING BODY HAVE BEEN FULLY APPRISED BY THE <br />LOCAL PUBLIC: AGENCY~ AND ARE AWARE OF THESE FACTS AND CONDITIONSS AND <br /> <br /> WHEREAS~ THERE HAS BEEN PREPARED AND REFERRED TO THE CITY COUNCIL OF THE <br />LOCALITY (HEREIN CALLED THE ~tGOVERNING BODYt~) FOR REVIEW AND APPROVAL A REDEVELOPMENT <br />PLAN FOR THE PROdECT AREA~ AS AMENDED BY AMENDMENT NO. 1~ AND DATED JUNE 19~7 AND <br />CONSISTING OF SEVENTEE~ PAGES OF TEXT AND ~ EXHIB1TSS AND <br /> <br /> WHEREAS, SAID REDEVELOPMENT PLAN HAS BEEN APPROVED BY THE GOVERNING BODY OF <br />THE LOCAL PUBLIC AGENCY~ AS EVIDENCED BY A COPY~F SAID BODYIS DULY CERTIFIED RESOLUTION <br />APPROVING SAiiD REDEVELOPMENT PLANS AND <br /> <br /> WHEREAS~ A GENERAL PLAN HAS BEEN PREPARED AND tS RECOGNIZED AND USED AS A <br />GUIDE FOR THE GENERAL DEVELOPMENT OF THE LOCALITY AS A WHOLES AND <br /> <br /> WHEREAS~ SAID REDEVELOPMENT PLAN FOR THE PROJECT AREA PRESCRIBES CERTAIN LAND <br />USES FOR THE PROJECT AREA AND WILL REQUIRE AMONG OTHER THINGS~ THE VACATING AND REMOVAL <br /> <br /> <br />
