10 <br /> <br /> Mr. Caravati made a motion to lay the motion on the table, Mr. Lynch seconded <br />the motion, and it was approved by the following vote. Ayes: Dr. Brown, Mr. Caravati, <br />Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: None. <br /> <br /> Dr. Brown asked if he is correct that they will qualify for fewer permit parking <br />spaces with this use and that a condition can be made that visitors must use on-site <br />parking, and Mr. Brown said yes. <br /> <br /> Mr. Lynch said one unresolved issue is whether it is advisable to have the BAR <br />consider the design. <br /> <br />Mr. Brown stressed that the final decision rests with Council not the BAR. <br /> <br /> Mr. Caravati concurred with Mr. Lynch, and said he feels we should solicit the <br />BAR's advisory opinion about the material compatibility, massing and roof. He made a <br />motion to refer the matter to the BAR for an advisory opinion. <br /> <br /> Mr. Lynch seconded the motion, but questioned if they can do it in a timely <br />fashion, noting that doing this will defer the matter until August. <br /> <br />Mr. Caravati said Council has a year to make a decision about a special permit. <br /> <br /> The motion to refer the design to the BAR for an advisory opinion was approved <br />by the following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch. Noes: <br />Mr. Schilling. <br /> <br />RESOLUTION: NEIGHBORHOOD DRAINAGE PROGRAM POLICY <br /> <br /> Mr. Tony Edwards, Engineer in Neighborhood Development Services, explained <br />that the Neighborhood Drainage Program was established to assist citizens with drainage <br />problems. He said that changes are being recommended that will allow the program to <br />continue in the most effective manner. The major change is to allow a one-time billing at <br />the end of construction, with the amount to the citizen bound to the estimate and <br />requiring citizen satisfaction prior to payment. Mr. Edwards said that citizens would be <br />allowed to make three equal payments for three years. <br /> <br /> Mr. Caravati asked if payment is secured by a lien on the property, and Mr. <br />Edwards said a letter of agreement is required, but a lien could be taken if payment is not <br />made. <br /> <br /> Responding to a question from Mr. Caravati, Mr. Edwards said there has been <br />very little participation in the special assistance program and most people who use it <br />could be eligible for CDBG funds. <br /> <br /> Mr. Caravati asked if there has been a problem collecting payment, and Mr. <br />Brown said he cannot recall a collection program. He said that if the payment is a large <br />amount it would be prudent to do a lien. <br /> <br />Mr. Edwards said that revision can be made. <br /> <br /> Ms. Hamilton noted that CDBG funds would only be available to people who live <br />in target neighborhoods, and asked if there are other programs available to meet that <br />need. <br /> <br /> Mr. Edwards said he is not aware of any other program, but noted that the City is <br />providing 75% of the cost of projects. <br /> <br /> Mr. Caravati recommended reducing the special assistance portion from 20% to <br />10%. <br /> <br />Mr. Brown suggested language be added to allow a lien on property. <br /> <br /> <br />
