39 <br /> <br /> Responding to a question from Mr. Schilling about phase I and parking concerns, <br />Mr. Tolbert said that no parking waivers will be granted administratively for phase II, and <br />any waiver request will go to the Planning Commission and Council. <br /> <br /> Mr. Schilling thanked Mr. Hayes for the tour of the property, and said he <br />understands and appreciates what he is trying to do. He said he would find the proposal <br />more favorable if the developer just gave the land to Habitat and have them do their <br />thing. <br /> <br /> Mr. Caravati said that is probably a good idea, and asked that the City Attorney <br />speak with the Rivanna collaborative to work out the details. <br /> <br /> Mr. Schilling said the City Attorney has said that the City could donate the land to <br />Habitat, and suggested that this be looked at prior to the second reading. He said he <br />would be willing to move forward tonight on that basis. <br /> <br />Ms. Hamilton asked Mr. Hayes to comment on the level of development. <br /> <br /> Mr. Hayes said that from Rivanna LLC's perspective, they want to create <br />something continuos, with similar character of design and sustainable issues. He said he <br />feels it is important that they do the design work rather than leave it up to Habitat. He <br />said Habitat likes the idea ofRivanna LLC being involved in the design and the intent is <br />to keep the costs minimal for those lots. <br /> <br /> Mr. Schilling said there is no estimate at this time, nor identified funding for <br />building a pocket park, closing the turnaround, and relocating the playground. He said he <br />would like this examined prior to the second reading. <br /> <br /> Mr. Lynch said that Mr. Schilling makes a good point, but he feels that having <br />neighborhood access to the existing or new playground is important. <br /> <br /> Mr. Mike Svetz, Director of Parks and Recreation, said that the current <br />playground is in the floodway and does not meet federal standards. He said relocation of <br />it will be placed on the priority list. <br /> <br /> Dr. Brown said he thinks this is an innovative proposal that takes unusable City <br />parkland and improves neighborhood access to the park. He said it also provides <br />affordable housing. He said he is interested in seeing the proposal go forward. He said <br />he likes the idea of the design all fitting together. <br /> <br /> Mr. Caravati made a motion to approve the ordinance, amending paragraph 3, <br />number 2 to saying "working in cooperation with Habitat for Humanity to assure that the <br />sales price is not more than $110,000. <br /> <br /> Mr. Lynch seconded the motion and amended the motion to add that the first <br />affordable unit must be built in not more than three years. <br /> <br />Mr. Caravati accepted the amendment to the motion. <br /> <br /> Mr. Tolbert said Habitat will need to be contacted about this amendment, but said <br />he thinks they will agree as long as it is clear that the $110,000 is the mortgage amount, <br />not the value of the home. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AUTHORIZE AN EXCHANGE <br />OF PROPERTY AT RIVERVIEW PARK BETWEEN THE CITY AND RIVANNA <br />COLLABORATIVE, LLC, as amended, was offered and carried over to the next meeting <br />for consideration. <br /> <br /> <br />
